1966 SDE (T) Reversion Case : The case was heard Today in Hon'ble Delhi High Court. The next date of Final Hearing is given 27th August'2007.

During hearing we could understand that Hon'ble Court will be issuing instructions to respondents DOT/BSNL not to operate revised Seniority list of TES Group 'B' Officers issued on 11.11.2004. In view of Hon'ble Court directions reversion will become in-effective till the outcome of the Final Decision.

(a) implementation of BSNL Executives' Promotion Policy :- Director (HRD) informed that one meeting is being convened by Shri M.K. Shau, Joint Secretary (Telecom) DoT on 27th Dec'2006to discuss the matter wherein he will also be present. He assured that efforts are being made for early implementation. 

(b) DPC of JTO(T) to SDE(T):- Director (HRD) informed that DPC work is over. Some transfer & posting work is under process & shortly promotion order will be issued.

(c) Promotion from SDE(T) to Adhoc DE:- Director (HRD) informed that the DPC work is held-up due to some court cases. BSNL has already taken legal opinion on TES Group 'B' seniority list & has sent to DoT for final opinion. On receipt of the instructions from DoT on the matter DPC will immediately be completed.

(a) BSNL Executivies' Promotion Policy :- DDG(Estt.) informed that the BSNL Executives' Promotion Policy is under consideration to Pension Cell and assured that by the end of this month the same will be cleared.

Formal Meeting with Chairman TC & Secretary, DoT: The Formal meeting with Chairman TC & Secretary, DoT is postponed. The meeting is expected to be held in the First Week of January'2007.

ABSORPTION OF GROUP 'A' OFFICERS - COURT CASE :-  Case filed by ITSA in the Hon�ble Delhi High Court came for hearing on 13th Dec'2006. Next date of hearing is 19/01/2007.

Comrade Rakesh Pandey, Convener Coordination Committee of CPSUs and Secretary General of National Federation of NTPC contacted Comrade GS to join the ongoing Trade Union Actions Programme for the settlement of various pending demands. Comrade GS alongwith CHQ Office bearers will have meeting on 18.12.2006 in the matter.

Comrade A.K. Kaushik, GS "Telecom Executives' Association of MTNL" [TEAM] contacted Com. GS to form a Federation of like minded Executives' Associations of Telecom CPSUs. All the Circle Secretaries are requested to submit their suggestions on the matter immediately.

GS writes to The Chairman TC & Secy. DOT, Govt. of India, New Delhi-110001 regarding  Denial of Training allowance and leave salary to Executives retiring from training centre vide letter no.  AIBSNLEA/CHQ/06-07/191 dated: 13-12-2006 Click Here for Letter

JTO(T) to SDE(T) promotion orders to fill up about 1000 vacant TES Group 'B' post are expected to be issued by the end of this week.

DPC to fill up about 2315 DEs posts on adhoc basis from SDE (T) is under process. Legal opinion sought by DoT regarding recent Hon'ble Supreme Court clarification on TES Group 'B' seniority list is expected to receive by end of this week from Addl. Solicitor General.

GS spoke to Sh. Satish Tandon, DDG(Estt.) DoT & discussed :-

(a) Status of BSNL Executives' Promotion Policy :- DDG(Estt.) informed that Member (S) has sent file for further comments on the matter. He assured that soon file will be return to Member (S). We are expecting approval of DoT before our formal meeting with Secretary DoT scheduled on 19.12.2006.

(b) Clarification regarding Pay Fixation :- DDG(Estt.) provided the clarification copy issued by DoT which was already taken up by us. (Click Here for clarification copy)

(c) Legal opinion regarding TES Group 'B' All India Seniority List :- DDG(Estt.) informed that legal opinion from Addl. Solicitor General on the matter is expected soon. He assured that matter will be clarified to BSNL / MTNL by the end of Dec'2006.

With our persistent efforts, the file regarding BSNL Executives' Promotion Policy has been cleared by Member (Finance) and reached Chairman Telecom Commission. The Chairman  TC has further marked the same to Member (Services), DOT. We are expecting that before our formal meeting with Ch. TC next week, the same may get clearance from DOT. Our consistent persuasion will continue.

GS and FS met DDG(Pers), BSNL and discussed:

 i)  Promotion from JTO(T) to SDE(T):  DDG(Pers) confirmed that the DPC work is over. The promotion orders are being issued shortly after deciding the posting on promotion and consideration of pending request transfers.

ii)  Promotion from SDE(T) to Ad-hoc DE:  DDG(Pers) informed that the DPC work is under process but promotion order can be issued after getting clarity from DoT on pending court cases.

iii) Notification of LDCE to fill up about 4000 TES Group B vacant posts: DDG(Pers) informed that just after issuing of promotion order of SDE(T) the notification will be issued immediately.

iv) Left out cases of promotion of Ad-hoc DEs (about 14 cases) : DDG(Pers) assured an early action.

v) Delay in issuing pension order:  DDG(Pers) informed that there had been delay in issuing the final pension order due to non-receipt of vigilance clearance from circles in new vigilance proforma.  The cases pending for the month of October 2006, in most of the cases vigilance clearance has now been received and sent for confirmation to CVO. Pension orders will be issued shortly.

vi) Issue of Sanction of Furnishing Allowance for BSNL Executives in Corporate Office:   DDG(Pers) assured to look into.

vii) Filling up of the vacant STS group A posts in Corporate Office on local officiating basis:  DDG(Pers) assured to look into.

viii) Issue of clarification regarding filling up of vacant PAs posts on officiating basis as asked by some cirlces:  DDG(Pers) assured an early action.     

1. Implementation of Executive Promotion Policy:   Director(HRD) confirmed that the Executive Promotion Policy cleared by BSNL Board was sent to DoT two months back, but the approval of DoT is still awaited.  He assured to talk to Member(S) and Member(F), DoT so that the same is cleared without any further delay.

2. Giving date of effect of implementation of revised/upgraded pay-scales from 1.10.2000:   Director(HRD) informed that the Dr. Shahi Committee report on the matter is being processed in BSNL.

3.  One time placement of SDEs in the grade of Sr. SDE:  Since the issue was not the part of the terms and conditions of absorption, the Bhave Committee did not agree for the same.  Any decision in this matter can now be taken by BSNL only after the Executives� Promotion Policy is implemented.  We insisted upon him to re-start the internal exercise on the issue in BSNL.

4.   Service Weightage :   We insisted that 100% service weightage should be provided to the absorbed executives for the services rendered by them in DoT/DTS/DTO in regular/ad-hoc/in-situ capacity. Director(HRD) informed that since this was not a part of the terms and conditions of absorption, the issue will separately be looked into in BSNL.

5.   Sanction of Man-Power Plan: Director(HRD) informed that the concerned branch has been directed to place the memo before the Board for approval.

6.    Promotion from TES Group B to DEs on ad-hoc basis:  Director(HRD) informed that the process of DPC has been started but the promotion order will be issued after getting legal clearance from DoT in view of various court cases pending including the clarification/decision of the apex court.

7.   Regular promotion from JTO(Telecom) to SDE(Telecom) :  Director(HRD) informed that the DPC process is over.  Circles have been asked to furnish the stay particulars so that the posting orders can be issued together with the promotion order. He also assured to consider pending request transfers.

8.  DPC from SDE(E) to EE(E), Cancellation/abolition of qualifying Accounts Examination for Electrical/Civil Wing officers, Officiating arrangement of Adhoc STS (Non-JTS) officers to JAG, Removal of FR 35 for officiating JTOs and one time conversion of JTO posts from outside quota to 35% quota, Withdrawal of AAOs pay scale, Removal of discrimination based on qualification in the case of JTO(Arch), Lateral advancement of JTO(TF)/ACP for JTO(TF) after completion of 12 years, Revision of pay scale for OL officers, Upgradation of Steno grade III to Personal Assistant, Recruitment of JAO/JTO: Director(HRD) directed DDG(SR) to convene a meeting with the concerned DDGs to discuss the matter.  Thereafter, the matter will be discussed with Director(HRD) again.

9.    Implementation of upgraded pay scales for Section Officer/Private Secretary of CSS with effect from 1.1.1996:   Director(HRD) informed that the matter is to be discussed and likely to be approved in the forthcoming meeting of the Board of Directors on 12.12.2006.

10.  Transparent Transfer Policy: Director(HRD) informed that the DDG(Restructuring) Shri S B Khare Committee is yet to submit the report which is at the final stage.  On receipt of the report the issue will be discussed immediately in the BSNL Board.

11.   Policy for GSM Service Connection to all Executives, enhancement of free call limits on RSTC and Concessional Broadband Connection:  Director(HRD) informed that BSNL Management is reviewing the shortcomings of the policy shortly. 

12.    Systematic Onslaught on BSNL Executives by GMTD, Alwar, Rajasthan circle and affairs of Punjab Telecom Circle wherein BSNL Executives are being victimised with vengeance attitude:   After having detailed discussion, Director(HRD) assured to look into the matter and take early remedial action.

Pay Revision Committee in CPSUs := The Government has constituted a Pay Revision Committee for the executives and non-unionised supervisors of CPSEs under the Chairmanship of Justice M.J.Rao, Retired Judge, Supreme Court. Dr. Nitish Sengupta, Economist and former member-secretary, Planning Commission, Shri P. C. Parakh former Secretary, Department of Coal and Shri R.S.S.L.N. Bhaskarudu, former Managing Director, Maruti Udyog Ltd. and former Chairman, Public Enterprises Selection Board will be the members of the Committee.

Secretary, Department of Public Enterprises will be the ex-officio Member and Joint Secretary, Department of Public Enterprises will be Secretary of the Committee. The Committee will give their recommendations on the matter related to pay revision covering Board level functionaries, below-Board level executives and non-unionised supervisory staff of CPSEs numbering about 3 lakh.
