25.03.2013: Hon'ble  Delhi High Court judgment dated 19.03.2013 in Writ Petition 1803/2013 filed jointly by AIBSNLEA, SNEA(I) and BSNLEU praying for quashing the order of DoT dated 11.03.2013 to deploy unabsorbed ITS in BSNL.

Hon'ble  bench clearly states that the impugned orders dated 11.03.2013, which both in letter and spirit violate the orders which are passed in W.P.(C) 22515/2005 and especially the order passed in CM No. 16683/2012 (our impleadment application). 
Judgment:
"Learned senior counsel for the petitioners, on instructions rightly states that the petitioners are really aggrieved by the impugned orders dated 11.3.2013 which both in letter and spirit violate the orders which are passed in W.P.(C) 22515/2005 and especially the order passed in CM No. 16683/2012".
"--- Petitioners are also at liberty to initiate, if so required, appropriate independent proceedings in accordance with law".

The order of Hon'ble High Court is the outcome of DoT and BSNL order dated 11.03.2013 and a clear endorsement of the prayer contained in our WP. On the basis of this order, we are filing original application in Pr. CAT, New Delhi.
We engaged Senior Advocate Shri Neeraj Kaul for this case.

21.03.2013: GS, AGS(F),  AGS(HQ), CS BSNL CO met  Addl. Secy(T), DoT on 20.03.2013 and discussed:

  • Implementation of 78.2% IDA pay fixation case of BSNL employees: They requested for early clearance of 78.2% IDA pay fixation case as the same is a part of basic pay and also it affects the pensioney benefits of retired officers, which has been approved by BSNL Board long before. Addl. Secy(T) mentioned that decision will be taken as per rule and the same  will be informed to BSNL Board at the earliest.

  • Repatriation of ITS officer's case: They requested to provide the copy of Cabinet decision on ITS Officers absorption issue and expressed our serious concern against arbitrary deployment of ITS officers in BSNL, which is in violation of Hon'ble Delhi High Court judgment dated 15.02.2013. Addl. Secy(T) mentioned that the cabinet decision has been mentioned in the terms & condition of the letter dated 11.03.2013 and she clarified that ITS Officers will not be promoted against BSNL/MTNL posts & they will be relieved in diminishing order on year to year basis in next ten years and detained is already explained in Annexure-'C' of letter dated 11.03.2013. She further clarified that ITS Officers will get their promotion against 463 Group-'A' posts in DoT.

21.03.2013: GS, AGS(F),  AGS(HQ), CS BSNL CO met  Shri Uma Shanker, Jt. Secy(T), DoT on 20.03.2013 and greeted  him on  assuming the charge of Jt. Secy(T), DoT and discussed:

Implementation of 78.2% IDA pay fixation case of BSNL employees: They requested for early clearance of 78.2% IDA pay fixation case of BSNL Employees. Jt. Secy(T), DoT  mentioned that the case is pending in his office to examine the BRPSE observations on BSNL viability. He categorically mentioned that "I am fully convinced that your claim of 78.2% IDA pay fixation is correct.  However, I am trying to fulfill the requirement of BRPSE recommendations" and assured for early clearance.

19.03.2013: <<<CHQ NEWS>>> AIBSNLEA, SNEA(I) and BSNLEU Writ petition 1803/2013 filed jointly praying for quashing the order of DoT dated 11.3.2013 to deploy unabsorbed ITS to BSNL came up for hearing today in the Hon'ble Delhi HC. Hon'ble HC while mentioning the order of DoT dated 11.3.2013 is a clear infringement of the judgment of the Hon'ble HC in WP 22515/2005 and CM 16683/2013 (Application filed by AIBSNLEA, SNEA(I) and BSNLEU), however advised the applicants to move applications seeking similar relief at appropriate forum. Hon'ble bench during the course of argument observed that passing any order in the instant writ petition might prejudice contempt proceedings already initiated by the Hon Delhi High Court.

We engaged Senior Advocate Sh. Neeraj Kaul and heated arguments took place. UOI represented by Addl. Solicitor General Sh. Rajeev Mehra and BSNL by Sr. Advocate Sh. V. K. Rao. We will be taking further course of action shortly.

18.03.2013: The Contempt petition filed by AIBSNLEA, SNEA(I) and BSNLEU in the Hon'ble High Court Delhi against DOT orders dated 11.03.2013 to deployment of non-optee ITS Officers in BSNL came for hearing today in Hon'ble High Court of Delhi and after arguments, the contempt petition is admitted and  posted for hearing on 25th July 2013.

18.03.2013: Stay on SDE to Adhoc DE Promotion at Hon'ble CAT, Chennai on 1966 seniority revision: The said case came up for hearing today in Hon'ble CAT, Chennai and after argument the said case is now posted on 08.04.2013.

05.03.2013:  GS, FS, AGS(HQ), AGS(F) and CS UP(E) Circle met Director(HR/EB) and discussed:

  • Regularization of offg. JTOs: We requested for regularization of offg. JTOs as one time measure. Director (HR/EB) mentioned that due to Hon'ble High Court, Chandigarh directions, we are not in a position to do the same. He also mentioned that Management is fully aware with the issue and advised to suggest any legal solution in this regard.

  • Allowing All India LTC facility to BSNL employees, who has a retirement period less than 2 years: We requested to allow All India LTC facility to the employees who have a retirement period less than 2 years. Director (HR/EB) mentioned that Management is fully aware with the issue and assured to release necessary instructions at the earliest.

  • Promotion from DE to DGM: We requested to fill up vacant DGMs posts from eligible DEs. Director(HR/EB) mentioned that on our discussion/request with Sr. GM(Pers.) on yesterday, a letter has been issued to CGMT Kerala Telecom Circle for pursuing in the Hon'ble High Court Kerala through BSNL's Advocate for early delivering the judgment on 147 SDEs (LDCE Quota) Seniority Case.

04.03.2013: Present Status of ITS repatriation Case: ASG Sh. Mehra (DoT) today again mention to Hon'ble High Court to reconsider the judgment of dismissal of review application filed by him today morning. Hon'ble High Court Delhi again called the concern Advocates and after hearing their arguments, adhere its earlier judgment of dismissal of the review application.

04.03.2013: Hon'ble High Court Delhi dismissed DoT review application on ITS repatriation case: Hon'ble High Court Delhi today dismissed DoT review  application on ITS repatriation case. DOT filed review application to Hon'ble High Court Delhi praying that DoT is implementing Hon'ble High Court judgment dated 15.02.2013 for repatriation of ITS officers from BSNL/MTNL immediately & as per the decision of Union Cabinet ITS officers will further be sent on deemed deputation to BSNL/MTNL for the next 10 years and during these 10 years period, BSNL/MTNL will create their Management at higher level.

Hon'ble High Court Delhi at first instance itself dismissed the DOT review application & directed to implement Court order in its true spirit.

04.03.2013: Co-option on Vacant Posts of Vice president-I & CWC Member-III: Vacant Posts of Vice president-I & CWC Member-III due to transfer of Circle Office Body of AIBSNLEA Rajasthan has been filled up by Co-option of Shri B.C.Logar, DE Phones, Bhilwara, and Shri Rajesh Krishan Sharma, DE(BB), O/o PGMTD Jaipur respectively by the Central Executives' Committee at Udaipur.

02.03.2013: Central Executives Committee Meeting of Rajasthan Circle Held on 01-03-2013 at Udaipur: The 1st Circle Executives' Committee (CEC) Meeting of AIBSNLEA Rajasthan Circle was organised on 01.03.2013 at Conference Hall of Rajasthan College of Agriculture, Udaipur  in a grand  manner. Shri Prahlad Rai, General Secretary AIBSNLEA CHQ, Shri Ravindranath, FS, Shri Bhagwan Singh, AGS (HQ), Sh. Devesh Sharma, Organizing Secretary (North) and Shri Karan Singh, Advisor from CHQ side attended and addressed the meeting. The Open session of the conference was attended by Shri A.K.Bhargava, CGMT Rajasthan Circle as Chief Guest and Shri H.P. Meena, Sr. GM(F) Rajasthan Circle, Shri R.N. Mathur, GMTD Udaipur as Guest of Honour. Many persons from print and electronic media were attended the conference.

Chief Guest of the Open Session Shri A.K. Bhargava, CGMT Rajasthan Circle inaugurated the function by lightning of lamp. All the distinguished guests were welcomed by the garlanding. Com. R.K. Khokhawat, Branch Secretary, AIBSNLEA Udaipur branch delivered the welcome address.

Com. M.K. Morodia, Circle Secretary AIBSNLEA Rajasthan, in his key note address, explained that how the impact of latest technologies in taking place in our services. He mentioned about the untried efforts of the comrades of Rajasthan Telecom Circles in strengthening the position of entire BSNL Rajasthan Circle. Com. CS highlighted the problems of the shortage of materials in the field units and appealed the Management to ensure the proper supply of the material to the field units. Com. CS also mentioned the problems regarding the cadre and HR issues of the Executives of Rajasthan Circle and impressed upon for the early settlement of the same. He assured that if Management provides full support then the Executives' of Rajasthan Circle are committed for making BSNL, a vibrant Organisation.

Com. Karan Singh, Advisor AIBSNLEA CHQ, in his address, mentioned the need of settlement of the problems faced by BSNL Executives like Shortage of materials in the field units and non- delivery of materials in accordance of demand. He also impressed upon the final settlement of the ITS issue so that the environment of uncertainty may be end.

Com. Devesh Sharma, Organizing Secretary (North) CHQ, in his address explained that in which manner the BSNL is suffering from the discriminatory attitude of the Govt. of India. He explained the efforts of CHQ in continuously resolving the issues of BSNL Executives. He appealed that the proper supply of the materials, GSM equipments, MLLN Modems, Telephone instruments etc should be ensured for the viability of BSNL. He also impressed upon the need of Organisational action programmes and the concern of trade Unions in Viability of BSNL.

Com. Ravindranath, FS(CHQ), in his address appealed all the members to change the erstwhile DoT mindset and serve the customers more efficiently. He stressed upon the Excellent customer care mechanism. Com. FS mentioned that only good customer care and quality service can make BSNL a vibrant Organisation. He also stressed out the points related to viability of BSNL. He advised for avoiding to adopt the way of Courts for the settlement of HR issues.

Com. Bhagwan Singh, AGS (HQ), in his address thanked AIBSNLEA Rajasthan Circle for inviting him in the session and appealed all the members of making the BSNL a vibrant Organisation by providing the Quality of Services to them with excellent customer care.

Guest of Honour, Shri R.N. Mathur, GMTD Udaipur, in his address thanked AIBSNLEA Rajasthan Circle for inviting him in the session. He impressed upon the need of Team working in BSNL's present scenario. He further mentioned about the FTTH progress in Udaipur and smooth work of EPP/NEPP  in Udaipur SSA.

Guest of Honour, Shri H.P. Meena, Sr.GM(F) Rajasthan Circle, in his address expressed his delightness for inviting him in CEC, Rajasthan Circle at Udaipur. He expressed his firm believe for the good health of BSNL up to 2015. He mentioned that in Rajasthan Circle, there is overall 20 Crores saving is there as compared to last year. He further mentioned that now the tariff war is over and now if the tariff will enhance 15%-20%, then the revenue of Rajasthan will enhance by approximately 300 Crores. He presented the finance figures of the SSAs of Rajasthan Circle in various segments. He appealed all for the maximum revenue  realization for the viability of BSNL. At last he thanked AIBSNLEA Rajasthan Circle for inviting him in the session

GS AIBSNLEA, Shri Prahlad Rai, congratulated the comrades of Rajasthan Circle for the successful conference and thanked the comrades for their great affection. In his detailed address Com. GS mentioned that today the Quality of Service is a big challenge in front of BSNL and in view of this AIBSNLEA found the concept of Customer Delight Month in its CHQ Office Bearer's meeting. Com. GS further mentioned that due to un-helping and over-jealous  attitude of the Govt. i.e. unjustified payment of spectrum charges (3G & BWA) of Rs. 18,500 Crores, non-reimbursement of licenses fee, USO Charges, OPEX Charges, withdrawal of ADC, Payment of AGR, Huge expenditure on Telegraph services, payment of notional loan Rs. 7500 Crores to DoT has adversely affected the viability of BSNL. Non-procurement of GSM equipment, cables, telephone instruments, MLLN Modem, Broadband Modem, Drop wires etc has affected the quality & growth of services. He stressed to strengthen the quality of our mobile services to enhance the MNP towards BSNL like on the same pattern in Karnataka, AP and Orissa. He explained that how the AIBSNLEA is continuously pursuing these viability related issue with the BSNL Management and DoT. 

Com GS. Further explained the burning issues of the Headquarters level like ITS Repatriation process and Cabinet Note and 78.2 % IDA fitment benefit case. He mentioned that Govt. has practically failed to settle the ITS issue and now the Govt. has taken the 'U' turn. He mentioned that trade Unions are Vigilant on the ITS issue but the uncertainty on this issue is not healthy for the viability of BSNL. He explained in detail about the issues like VRS, 30% disinvestment and unbundling of last mile copper. He apprised the status of HR issues related to various DPCs from JTO to SDE, SDE to DE(Adhoc/Regular), DE to DGM, JAO to AO, AO to CAO & CAO to DGM(F), DPC in Civil/Electrical wing, Restructuring of AD(OL) case etc., meeting of Remuneration Committee, VRS, Pay anomaly- Sr. are drawing less salary than their juniors, stopping of LTC, CPSU cadre hierarchy, regularization of Officiating JTOs etc. Com GS explained the role of AIBSNLEA in the viability of BSNL. He mentioned the success of AIBSNLEA in creation of Retirement Leave encashment fund of Rs 4825 Crores by the BSNL Management, by which BSNL is getting 400 Crores interest. At last he appealed the all Executives' and all the BSNL pensioners  for make every effort with a team spirit for making BSNL a vibrant organization. At last he congratulated AIBSNLEA Rajasthan Circle for the success of the open session. During interactive session, Com.GS replied all the queries raised by the members.

Chief Guest of the Open Session Shri A.K.Bhargava, CGMT Rajasthan Circle thanked all the delegates of Rajasthan Circle for inviting him in the conference. He appreciated Com. GS for his untried efforts at the Central Headquarters. He  suggested to resolve the problems by mutual discussions. He mentioned that views from all sides are important and we should respect them for problem solving. He suggested that we should do efforts from today itself for making BSNL a vibrant organisation. He assured that the the Circle will soon cop-up with the problem of shortage of material and we should try to give our best results in available resources. He suggested that layout and plans for the upcoming technologies like NGN and IP based networks should be prepared. He impressed upon making of pleasant atmosphere for attracting the customers and make them satisfied and delighted from our services. Officiating from SDE to DE Case: Shri A.K.Bhargava informed that at least any reply or clarification needed from BSNL HQ to initiate the process since the case is pending with BSNL HQ the case cannot be initiated. We had made some alternate solutions, he assured to examine the solutions.

Transfers on completion of tenure breakup of 2 years: Shri A.K.Bhargava informed the the management is seriously working out to resolve the problem in effective reliving of such executives  who have completed the tenure period. he also appealed us to bring any solution so that effective replacement of such executives can be done.

Pending IDA Upgradation/ACP cases in every Stream: it was informed that every concerned unit is instructed to resolve all the cases at an earliest.

Individual grievances: Every individual grievance will be settled at top priority on Merritt basis.

20.02.2013: Today GS, AGS(HQ) and CS, BSNL Corporate Office met Secy(T), DoT and discussed regarding

  • Implementation of 78.2% IDA pay fixation benefit in BSNL: We requested Secy(T), DOT  for kind intervention to the approval of DOT on 78.2% IDA pay fixation case as approved by BSNL Board. We also informed that on the query raised by DoT, BSNL is going to submit their reply shortly.  We also informed that it is a part of the our salary and as on the day of issuance of DPE order on 2nd April'2009, BSNL profit was more than Rs. 574 Crores, therefore, in this regard, DoT should issue presidential directives at the earliest. We also mentioned that due to non implementation of the same, the pension of the BSNL pensioners is also affecting. Secy(T), DoT appreciated our concern and assured to look into the matter.

20.02.2013:  United Forum of BSNL Executives' Associations Meeting: GS, AGS(HQ) along with GS, President SNEA(I) and GS, VP AIGETOA hold meeting and discussed on introduction of CPSU Cadre hierarchy, implementation of E-2, E-3 standard IDA pay scales and abandon of 25% posts of DGM/DE level in BSNL etc. After detail discussions it is decided that Committee on CPSU Cadre hierarchy should first discuss the draft proposal submitted by United Forum and also decided to meet Director(HR) to start discussion in Committee on implementation of E-2, E-3 standard IDA pay scales. Also decided to strongly protest against the move of abandon of 25% posts of DGM/DE level in BSNL, first by giving letter to Hon'ble MOC&IT, Sect(T) and CMD, BSNL and thereafter organisationally.

19.02.2013: Status of ITS Officers absorption issue: GS, AGS(HQ) met concern DoT officers and discussed regarding ITS Officers absorption issue. It is understood that the Cabinet Note sent by DoT has been approved by Cabinet in its meeting held on 13.02.2013. The silent feature of the Cabinet Note are reliably learnt as under :

  • The absorption process of Group-'A' Officers in BSNL/ MTNL will end henceforth.

  • The Group-'A' & 'B' level Officers absorbed in BSNL/MTNL, their seniority is de-linked with the Group-'A' officers on deemed  deputation to BSNL/MTNL.

  • The Group-'A' & 'B' level executives of BSNL/MTNL will get promotion against  STS/JAG/SAG/HAG level posts on priority.  The 941 ITS Officers in BSNL and 83 ITS Officers in MTNL will be posted against remaining vacant JAG/SAG/HAG level posts.

  • The deemed deputation of 941 ITS Officers in BSNL and 83 ITS Officers in MTNL is allowed to continue for the next 10 years. About 40 ITS Officers from lower grade (i.e. JAG) will be relieved every year progressively. (Similarly 10-15 ITS officers in SAG/HAG grade will retire every year). In this manner, in the next 10 years all the ITS Officers on deemed deputation in BSNL/MTNL will be repatriated to DoT.

  • The ITS Officers cadre will be restructured in DoT shortly and presently 463 ITS officers will be accommodated in DoT and against these 463 posts of JAG/SAG/HAG, the ITS officers will get their promotion till the time cadre is restructured in DoT.

  • During the period of 10 years, BSNL/MTNL Managements have to ensure to create their own top level Management so that 40 ITS Officers are relieved progressively on every year basis.

It seems that Hon'ble Court may not allow to continue deemed deputation in view of the earlier Govt. of India's policy, Court decision and discrimination towards absorbed employees. However, Association will continue to fight organisationally and legally against discrimination.

18.02.2013: DPE forwarded the representation of AIBSNLEA (Letter no. 18.02.2013: Committee Meeting held on MTRR: GS, AFS, CS BSNL C.O. and CS Delhi Circle along with representatives of SNEA(I) and AIGETOA attended the Committee Meeting on Review of MTRR . The executives' Associations representatives pleaded that since the Committee regarding introduction of CPSU Cadre hierarchy vis-a-vis present setup in BSNL is being held to discuss the matter, hence at this stage discussion on MTRR is irrelevant. We suggested that MTRR if needed may be discussed along with the CPSU Cadre hierarchy introduction itself. The Chairman and Committee Members Official side appreciated our concern and  adjoined the meeting to apprise the discussion  to the  Competent Authority. 17.02.2013: Com.M.K.Morodia, CS along with Com.Prahlad Rai GS attended the 'Open Session' of 1st Circle Conference of AIGETOA Rajasthan Circle today: Com.M.K.Morodia, CS along with Com.Prahlad Rai GS attended the 'Open Session' of 1st Circle Conference of AIGETOA Rajasthan Circle held at Hotel Maya International, Jaipur on 17-02-2013. the theme of open Session was "At the time of crisis: manage cost or employee moral". Com.Prahlad Rai and Com. M.K.Morodia addressed the house. Com. Prahlad Rai in his speech elaborately touched all the burning issues related to viability of BSNL and welfare of Executives. Com.Prahlad Ray explained that crisis of BSNL is not at the part of executives but is due to wrong policies of Govt. and failure of BSNL Management in procurement of stores, equipments. Com. 15.02.2013: MASSIVE DHARNA & LUNCH HRS. DEMONSTRATION ON 15th Feb'2013: Significant presence of Comrade Prahlad Rai, GS AIBSNLEA & Com. G.L.Jogi, President SNEA was the highlight of Dharana today in Jaipur. both the leaders addressed the lunch hrs. Demonstration on Dharana Place.

Comrade Prahlad Rai in his speech elaborately described the significance of the agitation in present agitating scenario in BSNL. He categorically explained the negative & malafide attitude of the management and what we have achieved through past agitational call. He also explained that how all the trade union calls have been protected BSNL & it's employees. He informed the gathering that every decision taken by CHQ leadership is taken after lot of discussions & after micro analysis. Welfare of the members/BSNL is always kept in view while taking any decision of trade union call. He appreciated the comrades of Rajasthan for organising successful agitational calls in Rajasthan.

15.02.2013: ITS REPATRIATION COURT CASE: Today Hon'ble High Court Delhi dismissed the application of respondents i.e. DOT/BSNL/MTNL for extension of time for repatriation of ITS Officers from BSNL & MTNL. 13.02.2013: BSNL Board remuneration committee meeting: It is understood that remuneration Committee of BSNL Board comprising Director (HR), Director (Fin), two independent BSNL Board Directors and one Govt. nominee Director in BSNL Board is continuously holding meetings in BSNL Corporate Office. Despite the protest of United Forum of BSNL Executive Associations, BSNL Management is considering to reduce the number of DGM/DE equivalent posts in BSNL instead of increasing the no. of posts against several new services are launched. Let us, get ready to protest against such ulterior motives of the BSNL Management shortly.

13.02.2013: GS, FS and GS SNEA(I) met concern officers in DoT and discussed about absorption issue. It is understood that Cabinet Note on absorption of Group-'A' ITS Officers in BSNL/MTNL submitted to Union Cabinet by DOT on 23.01.2013 & Supplementary Note on 08.02.2013  is coming for consideration in Union Cabinet Meeting today evening at 17.30 Hrs.

13.02.2013: CPC from SDE(E) to EE(E): GS discussed with PGM(EW)  regarding filling up of vacant EEs(E) posts. PGM(EW) mentioned that the provisional seniority list of SDEs(E) has been circulated for comments up to 21.02.2013. Also the information regarding higher qualification/degree acquired while in service has been called to finalize the seniority list. After receiving the comments and required information the final seniority list will be prepared and immediately CPC will be initiated to fill up about 40 EEs(E) vacant posts.

13.02.2013: Revision of MTRRs -2009: AIBSNLEA consistent effort yielded results in getting proposal for revision of MTRRs -2009. AIBSNLEA against the provisions of age and qualification in the MTRR-2009 for internal candidates immediately challenged in the Hon'ble CAT Ernakuam and got the direction to allow existing executives provisionally as internal candidates in MT examination. Against this BSNL Management made an appeal in the Hon'ble Kerala High Court and the appeal was dismissed. Similarly, some more cases were filed in different courts through out the country; hence BSNL Management filed case in the PB CAT New Delhi to get transferred all the cases in PB CAT, New Delhi. Hon'ble PB CAT, New Delhi allowed transferring the cases and AIBSNLEA further impleaded in the case at PB CAT, New Delhi.

Recently OA no. 777/2010 between BSNL V/s AIBSNLEA in Hon'ble PB CAT, New Delhi delivered final judgment wherein Hon'ble PB CAT directed that the ongoing MT recruitment process should be completed as per the interim direction given by the Hon'ble CAT Ernakulam (i.e.) without age and qualification restriction as per the prayer filed by AIBSNLEA.

This is a great victory for the stand taken by this Association, that the restriction of age and qualification in MT RR is discriminatory and the same is now vindicated by this judgment.

Consequent upon BSNL Management has prepared a revised draft on MTRR -2009 allowing B.Sc. Ist Class and 50 years age for internal candidates and has asked the opinion and views of the Association. Presently the issues raised by AIBSNLEA have been addressed upto some extent, but still on some points our views are to be submitted on 18.2.2013 to the BSNL Management. Now, our considered opinion is that since the CPSU Cadre hierarchy for non- post based promotions upto JAG selection grade is under discussion in Committee, the MTRRs has no relevance. 12.02.2013: GS, FS met CMD, BSNL and discussed

  • Implementation of 78.2% IDA pay fixation: We requested CMD for kind intervention to the approval of DOT on 78.2% IDA pay fixation case as approved by BSNL Board. CMD appreciated our concern and mentioned that he has already discussed the matter with Secy(T) in the presence of Addl. Secy(T) and Jt. Secy(T) and Secy(T) also feels that its a sensitive issue. However, he assured that shortly the reply will be sent to DoT, as on the day of issuance of DPE order on 2nd April'2009, BSNL profit was more than Rs. 574 crores.

  • Regularization of Officiating JTOs: We requested for regularization of Offg. JTOs as a one time measure. After some discussions, CMD advised to discuss the matter in details further.

12.02.2013: GS, FS, AGS(HQ) met Sr. GM(Pers.) and discussed:-

  • CPC from SDE(T) to DE: We requested for sincere efforts to get the stay order vacated in Hon'ble CAT Chennai from DE promotion. Sr. GM(Pers.) mentioned that efforts are being made to expedite CPC to fill up 760 DEs posts but due to court stay order the CPC process is stalled. However, he immediately called the concern AGM(Legal) to know the present status and spoke to CGMs Chennai & TN Circles for  making  efforts before Hon'ble CAT Chennai to get the stay order vacated since the applicants are not even into zone of consideration of the CPC.

  • CPC from DE to DGM: Sr. GM(Pers.) mentioned that Hon'ble High Court Kerala at Ernakulam has reserved the judgement after arguments on 147 SDEs LDCE quota seniority case. As soon as the judgment is delivered the promotion order will be issued. 

  • CPC from JTO(T) to SDE(T): We requested to fill up vacant SDEs(T) posts at the earliest. Sr. GM(Pers.) mentioned that the clarification asked from DOP&T through DOT is still awaited. However, he advised DGM(Pers.) to personally look into the matter for an early reply from DOP&T.

  • CPC from SDE(TF) to AGM(TF): Sr. GM(Pers.) mentioned that the clarification on SC/ST roster implementation from DoT is not clear that on which year judgment of Hon'ble APEX Court the CPC is to be conducted. Hence, further clarification has been asked from DoT.

  • Creation of PPS Posts in field units: We requested to cerate PPS posts in field units with CGMs posts like BSNL Corporate Office and as per Sh. H.K. Gupta, DDG(DoT) Committee recommendations. Sr. GM(Pers.) assured to look into the matter.

  • Restructuring of AD(O/L) Cadre: We expressed our serious concern against delay in submitting the Committee report headed by Addl. GM(Estt.) for the last one year. Sr. GM(Pers.) mentioned that the Committee report is being prepared & shortly it will be finalized.

12.02.2013: GS, FS met Director (Finance) and discussed:

  • Implementation of 78.2% IDA pay fixation case: We requested for early submission of reply to DoT on 78.2% IDA pay fixation case. Director(Fin.) in the presence of GM(CA) mentioned that the reply to DOT is being prepared shortly but the matter needs to be persuaded in DoT for approval.

  • CPCs to fill up DGM(Fin) posts & CAO on regular basis: We requested for early issuance of DGM(Fin.) and CAO regular promotion orders. Director(Fin.) mentioned that the CPCs are  in progress but VCRs for DGM(Fin.) promotion are awaited and for CAO regular promotion some ACRs are still awaited. However, he assured for an early action in this matter.

01.02.2013: United Forum of BSNL Executives' Association Meeting: The Central office bearers of AIBSNLEA, SNEA(I) and AIGETOA and  met on 1st Feb.,13 and held marathon and extensive discussions on how to defeat sinister, calculated and vindictive game plan of BSNL management to block legitimate and just career growth prospects of executives.

Central Office bearers of all the three Executive Associations strongly resented and took very serious exception to deliberate and calculated  actions of the Management to inflict irreparable and irreversible damage on career growth of executives.

The meeting unanimously urged upon BSNL management to give up its indifferent &  vindictive attitude towards executives and resolve the legitimate issues of just career growth of executives immediately failing which the management will force executives Associations to start harder Organisational Action Programmes.

30.01.2013: Status of Court Case in 147 SDEs LDCE Quota Seniority case: Hon'ble High Court Kerala at Ernakulam heard arguments about two and half hour and will  continue tomorrow also.

30.01.2013: DOT has addressed to CMD, BSNL to further clarify regarding Revision of scales of pay and allowances w.e.f. 01.01.2007 as per DPE O.M. dated 02.04.2009 as under:-

(i) During the 106th Meeting of the Board of Reconstruction of Public Sector Enterprises (BRPSE) held on 29.1L2012, the Board discussed the present status of operation/services, performance, financial position, revival status of BSNL and its future outlook. After deliberations, the BRPSE observed that "BSNL has become an incipient sick CPSE".

(ii) DPE's O.M. dated 26.11.2008 as well as 02.04.2009 on revision of pay for Board level and below board' level executives/non-executives stipulates that lower limits against the maximum prescribed limit can be provided in the Presidential Directives depending upon affordability, capacity to pay and sustainability of the concerned CPSE.

(iii) Proposed IDA fixation from @ 68.8% to 782% in respect of pensioners will have huge financial implication of government exchequer besides creating financial liability on BSNL's account on account of accumulated arrear of pay & allowances up to the date of retirement.

2. Further, DPE guidelines dated 09.11.2006 stipulates certain restrictions with regard to wage negotiation for unionised workers in CPSEs. Para 2 (V), (VI) & (VII) of aforesaid guidelines is reproduced as under:

(a) Para 2 (v): As regards sick CPSEs registered with BIFR, until BIFR approves the revival plan for such enterprise in which provision has been made for additional expenditure on account of wage revision, no revision of wage would be allowed to the employees of such CPSEs.

(b) Para 2 (vi): In case of sick/incipient sick CPSEs referred to BRPSE, the wage revision should be considered on the basis of final decision on the recommendations of BRPSE.

(c) Para 2 (vii): CPSEs which incurred net loss during any of three financial years preceding the proposed wage negotiation, but not referred to BIFR/BRPSE may also be allowed to enter into wage negotiation, provided they give an estimate to their administrative Ministry/Department as to how resources would be generated by them to meet the extra expenditure arising out of implementation of wage revision.

3. In view of specific observations of BRPSE, provisions in DPE guidelines and the facts that implementation of aforesaid proposal will  huge financial repercussions on Government as well as BSNL, the proposal may be re-examined and considered view of BSNL with methodology to be adopted, may be apprised to this office. 24.01.2013: Meeting of Forum of BSNL Unions/Associations held today: GS, AGS(F) attended the meeting of Forum of BSNL Unions/Associations today and discussed the issues related to Viability of BSNL i.e. Repatriation of non-optee ITS Officers, Procurement of Stores/material in Field Units viz Telephone instruments, B/B Modems, Dropwire, Cables, MLLN Modems, GSM Equipment etc. Also resented against non-implementation of agreement signed between BSNL Management and BSNL Unions/Associations on 12th Jun'2012 even after a laps of six months  period mainly 78.2 % IDA pay fixation, Child Care leave, Supernumerary benefits to BSNL recruited employees etc. Forum finally decided that they will immediately serve a notice of agitation programmes demanding immediate implementation of 78.2% IDA Pay fixation as per the agreement signed between BSNL Management & BSNL Unions/Associations as under:-

  • Savingram Campaign on 28th, 29th and 30th Jan-2013 to Secy(T) with copy to Hon'ble MOC&IT & CMD, BSNL.

  • MASSIVE DEMONSTRATION during lunch hour on 11.02.2013 at BSNL Corporate office, Circle/SSA HQs level.

  • One Day DHARNA on 15.02.2013 at BSNL Corporate Office, Circle/SSA levels.

Further course of action in terms of harder Trade Union Action programmes will be decided in the next Forum Meeting scheduled to be held on 22.02.2013.

23.01.2013: Status of contempt case in the Hon'ble High Court Chandigarh in JTOs(Offg.) case: The contempt case in JTO(Offg.) came for hearing in Hon'ble High Court Chandigarh today. ASG Mr. Hooda pleaded that as per the directions given by Hon'ble Court, BSNL has already notified JTO LICE to be held in June'2013, hence Hon'ble Court should consider for dismissal of the contempt notice. But Hon'ble Court did not consider the prayer and further posted case for hearing on 2nd May'2013. It is felt that affected JTOs should immediately implede in the case to explain their position.

23.01.2013: Status of Court Case in 147 SDEs LDCE Quota Seniority case: Hon'ble High Court Kerala at Ernakulam heard arguments of applicants side for one and half hour in 147 SDEs LDCE quota seniority case and further posted for hearing on 28th Jan'2013 (Monday) to complete the arguments. Court adjourned for four days by tomorrow due to continuous vacations.

23.01.2013: Hon'ble CAT Madras granted stay order against promotions from SDE to DE: OA no. 1216/2010 Thirunavukkarasu & Others Vs. UOI ralated to 1966 SDEs Seniority case. Hon'ble CAT Madras stayed the promotions from SDE to DE till the time reply is filed by BSNL. Case is posted for hearing on 07th Feb'2013. Reply already filed by BSNL yesterday but full Bench was not available. AIBSNLEA will impleade shortly. The CPC process to fill up about 760 DEs posts is further delayed for time being.

22.01.2013: GS along with other representatives of Joint Forum of BSNL & MTNL Unions/Associations met Sh. Bhanwar Jitendra Singh, Hon'ble MOS for Youth Affairs and Sports, Govt. of India, New Delhi and submitted memorandum regarding Immediately end illegitimate deputation of non-optee ITS in BSNL/MTNL to protect the viability of Government's prestigious and strategic telecom companies, BSNL & MTNL, which are fast sinking. Take immediate steps to end decade old exploitation and discrimination of absorbed / recruited employees of BSNL & MTNL either by taking them back to DOT or immediately repatriating unabsorbed ITS to DOT -  End existing dangerous duality. 22.01.2013: GS, OS (North) met GM (Estt) and discussed:-

  • Regularization of offg. JTOs: We further requested for regularization of offg. JTOs as one time measure. GM (Estt) mentioned that the contempt case hearing is coming tomorrow in the Hon'ble High Court, Chandigarh and as per the court decision only further action will be taken. He also informed that Addl. GM(Estt.) has already gone to Chandigarh to discuss the matter with ASG and BSNL Advocate along with GM(Admn.) Haryana Telecom Circle on this issue. It is understand that in case , the hearing is further delayed than affected JTOs should immediately implead in the case to explain their position.

  • Reply to DOT on 78.2% IDA fixation case: We requested to sent early reply to DOT on 78.2% IDA fixation case. GM(Estt.) mentioned that till date he has not received the DOT letter. However, the queries made by DOT seems to be related to finance wing and CP&M Wing, who are dealing with BRPSE etc. He assured that Estt. Section will take immediate action in this regard.

22.01.2013: GS & President, SNEA (I) met GM (SR/Trg.) on 21.01.2013 and discussed:-

  • Filling up of vacant DEs  posts: We requested for filling up of vacant DEs posts as per the provisions of BSNL MSRRs. GM (SR/Trg.) assured to discuss the matter with Competent Authority.

  • Review of Online Mandatory Training under EPP: We requested to review Online Mandatory Training under EPP wherein the executives having more than 55 years age are to be exempted from this training and the executives who are not computer friendly may be sent to RTTCs for 2 weeks mandatory training. GM (SR/Trg.) assured to look into the matter.

  • Holding of CPSUs Cadre Hierarchy Committee Meeting: We expected our serious concern against non-holding of CPSUs Cadre Hierarchy Committee Meetings. GM (SR/Trg.) mentioned that committee is seized with the issue but finding difficulty in accepting the proposal gives by Executive Associations.

  • Membership verification of Executive Associations: GM (SR/Trg.) asked the associations view on membership verification of Executive Associations, mentioning  that Management is seriously thinking in this regard. We assured that shortly we will give our views/opinion on this issue.

22.01.2013: GS, AGS (HQ) met Sr. GM (Pers) on 20.01.2013 and discussed:-

  • CPC from DE to DGM: We requested to expedite CPC from DE to DGM. Sr. GM (Pers.) mentioned that CPC from DE to DGM is in progress and posting on promotion order will be issued shortly. It is understood that about 200 DGM posts may be filled-up with the eligible DEs.

  • CPC from SDE(T) to DE: We requested to fill-up vacant DEs posts. Sr. GM (Pers.) mentioned that CPC from SDE(T) to DE (Adhoc) has been initiated to fill-up about 760 DEs posts. Efforts are being made to collect last year (One Year) ACRs and VCRs of the eligible SDEs. He assured that as soon as the ACRs/VCRs are received, CPC will be completed. It is understood that in case, ACRs/VCRs are received immediately the promotion order may be released in the month of Feb-2013 itself.

  • CPC from  JTO to SDE (T): We requested to expedite CPC from JTO to SDE (T). Sr. GM (Pers.) mentioned that the clarification from DoT regarding diverting of seniority-cum-fitness quota SDEs posts to LICE quota & vice-versa has not been received. However, the efforts are being made to collect the ACRs of the eligible JTOs for SDE promotion.  

  • CPC from SDE(TF) to AGM (TF):  We requested to issue promotion order from SDE (TF) to AGM (TF) since the CPC has been completed 10 months before for the want of clarification from DoT on SC/ST candidates reservation on their own merit issue. Since, the clarification from DoT has been received on 18/1/2013 on this issue, based on that promotion order may be released. Sr. GM (Pers.) assured to look into the matter.

21.01.2013: BSNL / Telecom NEWS IN MEDIA:

20.01.2013: GS, AGS(HQ) met GM(FP) on 18.01.2013 and discussed:

  • CPC from CAO (Adhoc) to CAO (Regular): We requested to expedite CPC from CAO(Adhoc) to CAO(Regular). GM(FP) mentioned that CPC is in progress but it is being delayed due to missing ACRs and the detail of missing ACRs is given. He advised to help in arranging ACRs at the earliest. We assured him an early action.

  • CPC from JAO to AO: GM(FP) informed that the reply in Hon'ble CAT Chandigarh has already been filed in case is posted for hearing in Feb'2013. He expected in the next hearing date stay order on CPC will be vacated.

  • CPC from CAO to DGM(F): We requested for early filling up of vacant DGM(F) posts. GM(FP) mentioned that  CPC is already in progress but getting delayed due to missing ACRs of 16 CAOs. However, he assured an early action in this regard.

  • Consideration of request / tenure transfer cases of AOs/CAOs: We requested for consideration of request/tenure transfer cases of AOs / CAOs. GM(FP) assured to consider all the cases in the month of Feb'2013.

20.01.2013: Hon'ble PCAT New Delhi delivered an important judgement in Management Trainee RR: AIBSNLEA initially filed case in Hon'ble CAT Ernakulam [PT No. 338/2009 OA No. 690/Ernakulum/2009 Dy. no. 10442 dated 26.11.2009 between BSNL V/s AIBSNLEA] praying to quash the RRs and Hon'ble CAT Ernakulum quashed the MTRRs wherein age and qualification has debarred most of the DOT recruited executives and absorbed in BSNL. Hon'ble High Court Kerala dismissed BSNL's appeal in this case and thereafter BSNL Corporate Office got transferred all the cases in Hon'ble PB CAT New Delhi [ OA no. 777/2010 between BSNL V/s AIBSNLEA] . AIBSNLEA continues to pursue in the Hon'ble PB CAT and now Hon'ble PBCAT New Delhi declared that the restriction on age and qualification for internal candidates in the MT RR is arbitrary and discriminatory and directed the BSNL Management  to revise the MTRR accordingly.

Hon'ble PB CAT  also directed that the ongoing MT recruitment process should be completed as per the interim direction given by the Hon'ble  CAT Ernakulam  (i.e.) without age and qualification restriction as per the prayer filed by AIBSNLEA.

This is a great victory for the stand taken by this Association, that the restriction of age and qualification in MT RR is discriminatory and the same is now vindicated by this judgement.

This Association is fighting this case along with SNEA(I) in  Hon'ble PB CAT, New Delhi.

17.01.2013: GS, FS met Director(EB/HR) and discussed:-

  • Filling up of vacant DEs Posts: We requested to fill up all vacant DEs posts as per the provisions of BSNL MSRRs. Also thanked to allow CPC to fill up 760 DEs posts of seniority-cum-fitness quota and further requested that as per BSNL MSRRs the proposal to fill up 1100 MT quota should also be allowed so that in a single CPC the 1860 DEs can be promoted which will remove the stagnation in the SDEs(T) carrier since a SDE(T) promoted in 1994 DPC year is waiting for his 2nd promotion after 19 years of services as DEs. These SDEs could get only one regular promotion from JTO(T) to SDE(T) during their 30 years of service. Moreover, most of them are drawing DE Scale. Director(EB/HR) assured to further discuss the matter with the competent authority.

  • Promotion from DE to DGM: We requested to fill up vacant DGMs posts from eligible DEs. Director(EB/HR) assured an early action in this regard.

  • Modification in BSNL MSRRs of JTO(C/E/Arch) & SDE(C/E/Arch): We requested to provide parity to JTO/SDE(C/E/Arch) with JTO/SDE(T). Director(EB/HR) assured to look into the matter.

  • Stepping up of pay wherein seniors are drawing less pay than their junior on implementation of EPP: We expressed our serious concern against non-settlement of genuine issue to remove pay anomaly of senior executives who are drawing less pay than their junior executives on implementation of EPP despite of the judgement of Hon'ble Kerala High Court and filing SLP in the Hon'ble Supreme Court against this by BSNL whereas stepping up of pay has been allowed in non-executive cadres. Director(EB/HR) assured to look into the matter.

  • Regularization of offg. JTOs: We further requested to regularize offg. JTOs as one time measure as per the BSNL Board's decision to promote qualified TTAs on adhoc basis as JTOs but BSNL continued to issue only local officiating orders. Director(EB/HR) on the basis of our letter dated 02.01.2013 assured to re-examine the case at the earliest.

  • Holding of CPSU Cadre hierarchy committee meeting: We expressed our concern against non-holding of CPSU cadre hierarchy Committee meeting. Director(EB/HR) agreed that for a long time Committee meeting is not held. However, he assured for early holding of the Committee meeting.

  • Implementation of E2 & E3 standard IDA pay scales for JTO/SDE equivalent executives: As per DPE OM dated 24.12.2012, we requested to implement standard E2 & E3 IDA pay scales for JTO/SDE equivalent executives. DPE has clarified that no intermediate IDA pay scales will be allowed to CPSUs to implement. Director(EB/HR) assured to examine our letter in the light of DPE order and its financial implications.

17.01.2013: GS, AGS(HQ) met PGM(EW) and discussed:-

  • CPC from SDE(E) to EE(E): We requested to fill up about 40 EEs(E) vacant posts from SDEs(E). PGM(EW) mentioned that efforts are being  made to initiate CPC from SDE(E) to EE(E) and shortly the ACRs/VCRs will be collected from field units.

  • Modifications in BSNL MSRRs: We requested to propose for modifications in BSNL MSRRs to provide parity with JTO(T)/SDE(T) to JTO(C/E)/SDE(C/E). PGM(EW) assured an early action in this regard.

  • Consideration of request transfer cases of SDEs/EEs: PGM(EW) assured to look into the matter.

17.01.2013: GS, AGS(HQ) met PGM(Arch) and discussed:-

  • CPCs to fill up vacant AEs(Arch) and SDEs(Arch) Posts: We requested for filling up of 16 vacant EEs(Arch) posts. 12 EEs(Arch) are working. To fill up vacant 16 EEs(Arch) posts, eligible SDEs(Arch) are not available, hence a proposal for local officiating promotion under FR-35 is being processed to the Competent Authority for consideration.

  • Consideration of request transfer cases of SDEs(Arch): We requested to consider some long pending request/tenure transfer cases of SDEs(Arch). PGM(Arch) assured to look into the matter.

16.01.2013: Status of 78.2% IDA Pay Fixation Case: GS spoke to concern officers of DOT to pursue regarding implementation of 78.2% IDA Pay fixation. It is understood that yesterday DoT has further sent a letter to CMD, BSNL to reply some more queries. It seems that DOT administration is dragging the issue on one pretext or the other.

Hence, Forum of BSNL Unions and Associations need to take immediate steps in terms of harder Trade Union actions to get the justice for BSNL Employees. BSNL Management who signed agreement with Forum of BSNL Unions/Associations on this issue has never pursued the matter in DOT for its implementation.

  • Local Officiating from SDE to DE/AGM: we expressed our concern in delay of DPC Local Officiating from SDE to DE/AGM. though CGMT mentioned that the case is pending in wait of clarification by BSNL CO regarding guidelines issued by DPE in October 2010 regarding SC/ST Roster, yet he assured to early holding of the DPC in response of our protest that guidelines have not been endorsed by BSNL CO hence it is not relevant.

  • Consideration of request transfers & ensuring smooth reliving: CGMT requested for the opinion of AIBSNLEA for smooth implementation of rotational transfers. he also assured that rotational transfer will be done just to fulfill minimum requirement and to accommodate the requests.

  • Shri A.KBhargava informed that circle management has requested BSNL Corp. Office for relaxation in Para II(d) from Revised Guidelines of BSNL Employees' Transfer Policy so that any executives serving at Soft Tenure SSAs can directly be transferred to the Home SSA after completion of the stipulated period.

  • CPC from SDEs(T) to DE: We requested to fill up vacant DEs posts. Sr. GM(Pers) mentioned that Competent Authority has give clearance to fill up about 700 DEs vacant posts of seniority-cum-fitness quota. He advised to support in collecting ACRs/VCRs of eligible SDEs(T) at the earliest so that CPC can be completed in Feb'2013. We also requested to get the approval of filling up of vacant MT quota posts on adhoc basis from eligible SDEs(T).He further advice to discuss the matter with the Competent Authority.

  • Filling up of DGM vacant posts: Sr. GM(Pers.) mentioned that shortly action is being taken to fill up the vacant posts from eligible DEs.

08.01.2013: GS, FS met PGM(BW) and discussed:

  • CPC from JTO(C) to SDE(C): We requested for early holding of CPC to fill up vacant SDEs(C) posts. PGM(BW) mentioned that after the approval of the Competent Authority, the provisional seniority list of JTOs(C) has been prepared and being circulated for comments, if any, shortly. He also mentioned that seniority list has been prepared from the date of joining, which is treated date of confirmation. However, a long pending issue of seniority is being resolved. He assured that after receiving the comments and on finalization of final seniority list the CPC will be initiated to fill up vacant SDEs(C) posts.

  • Modifications in BSNL MSRRs: PGM(BW) assured to reexamine the BSNL MSRRs to provide parity to JTO/SDE(C) with JTO/SDE(T).

08.01.2013: Joint Forum of BSNL & MTNL Unions/Associations representatives met with Addl. Secy(T), DOT. Com. GS and FS were also present to discuss the following:-

  • Delay in implementation of DPE OM dated 2nd April,2009 on 78.2% IDA pay fixation case: We expressed our serious concern against delay in issuance of Presidential Directives from DOT on 78.2% IDA pay fixation for BSNL employees as recommended by BSNL Board. AST mentioned that matter is in progress and assured an early decision.

  • Refund of BWA Spectrum charges to BSNL/MTNL: AST informed that matter is in active consideration of Govt. However, Rs. 1500 Crores payment in lieu of Rural Service being provided by BSNL has been ordered.

  • 4.4% Additional 2G Spectrum charges from BSNL/MTNL: We requested that 4.4% additional charges of 2G Spectrum from BSNL/MTNL should be exempted as incumbent service providers and their present poor financial condition. AST mentioned that Ministry is preparing a Cabinet Note on this issue to provide relief to BSNL/MTNL shortly.

  • Payment of Pension to MTNL employees from Govt. fund as the case of BSNL: We requested that MTNL employees should also be paid pension under Rule-37A from Govt. fund as being paid to BSNL employees. AST mentioned that Govt. has taken a decision to form a Pension Trust in MTNL shortly. Jt. Forum opposed against formation of Trust as such it will not be viable. AST noted the feelings of MTNL employees.

  • Non-filling up of the vacant DGMs/DEs/SDEs posts in BSNL: We expressed our serious concern against non-filling up of vacant 600 DGM posts, 3000 DEs posts and about 3000 SDEs posts in BSNL on the pretext of Court cases, whereas there is no stay order pending against holding of CPCs. AST mentioned that DOT has already asked BSNL Management to put up the matter in the next BSNL Board Meeting.

  • Posting of absorbed Grp-'A' executives in BSNL's / MTNL's HR functions: We requested for posting of absorbed Group -'A' level executives in BSNL's/MTNL's HR functional posts to safeguard the interest of their employees etc.

04.01.2013: GS, AGS(Fin.) met GM(FP) and discussed:

  • CPC from CAO to DGM(F): We requested to expedite CPC from CAO to DGM(F). GM(FP) mentioned that CPC to fill up about 106 DGM(F) posts is in progress but about 25 ACRs from different Circles are yet to be received. However, he assured to expedite CPC at the earliest.

  • CPC from CAO(Adhoc) to CAO (Regular): We requested to issue CAO (Regular) Promotion order. GM(FP) assured an early action in this regard.

  • CPC from JAO to AO: We requested to pursue in Hon'ble CAT Chandigarh for getting stay order vacated of CPC from JAO to AO. GM(FP) mentioned that the reply from BSNL has already been filed in the Hon'ble CAT Chandigarh and it is expected that in the next hearing date stay may be vacated. However, the CPC work is in progress.

  • Left out CPC from CAO to DGM(F): We extended thanks for issuing three DGM(F) promotion order of left out cases after the clearance given by SC/ST Commission. Some cases could not be considered due to the below bench mark given prior to year 2008-09.

  • CPC from DE to DGM: We expressed our serious concern against non-filling up of vacant  DGM posts by eligible DEs. Sr. GM(Pers.) appreciated our concern and mentioned that it is the immediate requirement of BSNL also. However, he assured to discuss the matter with the Competent Authority regard shortly.

  • CPC from SDE(T) to DE(Adhoc): We requested to initiate CPC immediately to fill up all vacant DEs posts. Sr. GM(Pers.) mentioned that the proposal to fill up about 750 DEs posts of seniority-cum- fitness  quota has been prepared and is being sent to the Competent Authority for approval shortly. We further requested to re-process the proposal for utilization of vacant MT quota posts also as per the provision of BSNL MSRRs till the time MTs are recruited. Sr. GM(Pers.) advised to take up the matter with the Competent Authority.

03.01.2013: GS, AGS(HQ) met CVO, BSNL Corporate Office and discussed:

  • Deletion of names of executives from ODI list who are exonerated or awarded minor penalty: We requested to issue guidelines to delete the name of executives from ODI  lists immediately who are exonerated or minor penalty awarded instead of waiting for one year till the month of January. CVO mentioned that the matter as raised earlier by this Association was taken up with CVC to issue clarification. However, he assured to personally discuss the matter with Director CVC for an early clarification.

  • Early settlement of the long pending disciplinary cases: We requested for early settlement of the pending disciplinary / appeal cases as in some cases due to non settlement of the cases executives are retiring without getting their pensionery benefits. CVO assured to look into the matter.

02.01.2013: Online Certificate Programme of BSNL: BSNL offers online certificate programme for the benefit of students/employed/jobseekers to learn Telecom from the experienced faculty of BSNL. 
Theory part can be learnt online and practical sessions will be conducted on crores worth of live equipments in the nearest BSNL training centre. The focus is mainly on Telecom related topics like Broadband Technology, Digital Switching Systems, Digital Transmission Systems, IP, Networking and Cyber Security, Mobile Communications, Optical Fiber Technology and Telecom Support Infrastructure.

01.01.2013: All the Branch Secretaries are requested to remit Circle Quota up to date before 15.01.2013 and CHQ Quota up to date before 28.02.2013.

01.01.2013: GS, FS, AGS(HQ) and AGS(Fin.) met DOT/BSNL Officers and greeted on New Year-2013. During informal discussions it is understood that Cabinet Note on ITS absorption issue is being prepared in DOT based on Committee of Secretaries (COS) recommendations and after the clearance from Nodal Ministries, it will be sent to Cabinet for approval in the middle of Jan'2013.

  • The BSNL Board's proposal for implementation of DPE OM dated 2nd April'2009 on 78.2% IDA fitment pay fixation, it is understood that case is still pending in Internal Finance Wing of DOT for the Pay Fixation of BSNL Pensioners. However, DDG (TPF) assured for early clearance.

  • It is also understood that Govt. has taken decision to release Rs. 1500 Crores in lieu of ADC to BSNL and Govt. also considering refund of BWA Spectrum to BSNL.
