28.09.2012: BSNL management has filed an application in the Hon'ble High Court Delhi Praying

  • Grant sufficient time and flexibility to Respondent No.4 i.e. BSNL to revert/relieve the Petitioners (ITS Officers) back to their parent department i.e. DoT in phased manner; and

  • Pass such other or further order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.

In this manner BSNL management is ensuring  continuation of deputationist ITS officers in BSNL / MTNL till their retirement.

DOT administration on the advice of CMDs BSNL / MTNL and ITSA demand has also sent a Cabinet Note to the secretaries of nodal ministries for clearance and thereafter to cabinet for approval to allow continuation of deputation of ITS officers in BSNL / MTNL.

To contest against this AIBSNLEA, SNEA(I) and BSNLEU has filed  intervention application in the Hon'ble High Court Delhi.

The case is expected to come for hearing in the next week. Simultaneously, United Forum of BSNL Executives Associations has also served a notice of organizational actions.

27.09.2012: GS, FS, AGS (HQ), AGS (GD) met  Sr. GM (Pers.) to discuss:

  • Creation of PPS Post: They  requested for early creation of PPS posts for the field units.  They also pointed out that the creation of PPS posts in the field units was already approved long back by the DoT through the committee headed by H.K. Gupta, the then DDG (Estt.), DoT. Sr. GM(Pers.) informed that the case is under process and an early action will be taken in this regard.

  • Promotion avenue for the non-executives' already drawing the executive scale under ACP scheme: They pointed out that the stenographers in the field units those who have got  executive pay scale under ACP scheme is neither covered by the Executive Promotion Policy nor under Non-Executive Promotion policy.  These stenographers have to retire without having any future promotion under any scheme.  They requested for introduction of a promotion scheme which will cater the requirement of these stenographers'. Sr. GM (Pers.) informed that  a committee has already been formed to study the case.  The case will be looked into.

  • The issue of Anti-dating of DNI of seniors with respect to their juniors:  They requested for re-consideration of committee report on anti-dating issue.  Sr. GM (Pers.) mentioned that the committee report has already been submitted to the competent authority for approval.  In case competent authority desires, the committee may further look into the matter.

  • Seniors are drawing less salary than their juniors  on implementation of EPP:  They requested for allowing stepping up of pay of seniors with respect to their juniors as per FRSR and the judgment delivered by Hon. CAT Ernakulam and Hon'ble High Court Kerala. Sr. GM (Pers.) mentioned that the matter is being looked by SEA cell of BSNL Corporate office.  Matter may be discussed with Director (Finance).

  • CPC from DE to DGM and SDE to DE adhoc and regular:  They requested for early filling up the posts of DGMs and DEs. Sr. GM (Pers.) mentioned that the CPC to fill up about 400 DGM posts have been completed but the same is held up due to pending court case of 147 SDEs (LDCE quota) in the Hon. High Court, Kerala.   As soon as the final judgment comes, promotion order will be released.   He also stated that the CPC to fill up about 1300 DE posts on adhoc basis is in progress.  But promotion orders can be issued after the stay order is vacated by Hon'ble CAT, Jabalpur.

27.09.2012: Hon'ble High Court Kerala at Ernakulam  interim order on 147 SDEs (LDCE Quota) case:  The case was listed for hearing today in Hon'ble Kerala High Court at Ernakulam but could not be heard due to shortage of time. Now the case is posted for hearing on 09th Oct'2012.

27.09.2012: BSNL NEWS IN MEDIA:

26.09.2012: GS discussed with PGM(EW) regarding filling up of vacant EEs(E) posts at the earliest. PGM(EW) informed that as assured earlier to this association, the CPC to fill up about 40 EEs vacant posts has been initiated and shortly after receiving the missing ACRs/VCRs the CPC will be completed.

26.09.2012: Com. G.S., Com. K.P.Nair, AGS, AIBSNLEA along with GS & President SNEA(I) met Additional Secretary DoT, New Delhi on today.

The issue of immediate repatriation of ITS officers on completion of the deadline fixed by the Hon. High Court Delhi, Filling up the posts of CGMs/GMs/DGMs from the absorbed SAG/JAG/STS level executives withholding the promotion orders of DGM (Adhoc) even after completion the DPC on the pretext of pending court cases, etc. were discussed.

They emphatically suggested that there are sufficient numbers of ITS officers available those who have been absorbed in the BSNL to man the posts of Head of Circles,   They also stated that number of HAG/SAG posts are calculated by the ITS dominated BSNL management based on the old MIS reports instead of CDR based reports. 

Many SSAs are headed by the SAG level ITS officers which can now be manned by the JAG level officers based on the present norms.  Similarly, many SSAs are headed by the JAG level officers which can now be managed by the STS officers.

They strongly pointed out that the interest of the ITS officers is only to get the benefit of the Govt. status and continue to work in the BSNL without having any accountability towards the BSNL.

They have also given the feed back on  number of posts and working strength in the cadre of STS/ JAG and SAG level.

Addl. Secretary (T) after giving patient hearing mentioned that the problem is very much known to the DoT.  She also stated that whatever happened in the past is over and together They have to find out a solution.  DoT is initiating action in a manner wherein the interest of the absorbed employees are not harmed as well as the ITS officers problem is also resolved keeping the interest of BSNL on priority.

It is understood that DoT has send a Cabinet note to the Secretaries of nodal ministries for clearance and thereafter to Cabinet for allowing deputation of ITS officers in BSNL /MTNL as desired by both PSUs' CMDs.  BSNL management has already filed an application to Hon'ble Delhi High Court explaining the inability in relieving all the non-optee officers from BSNL and prayed to allow their continuation till the time DGMs / MTs are recruited in BSNL to own the responsibility.  Hence, it is clear that BSNL management effort is not to relieve any non-optee officers till their retirement.  However, They are to defend legally as well as organizationally against such discriminatory attitude of the Govt. and BSNL management.

24.09.2012: Hon'ble High Court Kerla at Ernakulam  interim order on 147 SDEs (LDCE Quota) case: 147 SDEs (LDCE Quota) Seniority case did not reach for hearing today in the Hon'ble Kerala High Court. Case is adjourned for hearing on the next working day. We may expect completion of hearing / arguments in this week itself since the case is listed for hearing in this week.

24.09.2012: SDE to DE(Adhoc) Promotion (1966 SDEs Seniority Case at Jabalpur): Hon'ble CAT heard the case today for two hours. Arguments completed. Hon'ble Court directed to submit written arguments on 8th Oct,2012. The final judgment may be delivered after 10-15 days.

20.09.2012: Forum of BSNL Unions and Associations Meeting with Secy.(T), DoT: GS, President along with the representatives of Forum of BSNL Unions/Associations met Secy(T) in the presence of Member(S), Additional Secretary (T), Joint Secretary (Telecom), Joint Secretary (Admn.), Director (Absorption Cell) etc. The Leaders of all major constituents of Forum were present in the meeting and discussed:

  • Absorption of ITS Officers in BSNL/MTNL: The Forum representatives expressed their serious concern against non settlement of ITS Officers absorption issue in BSNL / MTNL. They categorically told that continuation of non-optee ITS officers in BSNL on deputation is adversely affecting the viability of BSNL. The uncertainty among the ITS officers is not allowing them to concentrate for the growth and planning of BSNL. They also told that there should not be any discrimination to the BSNL absorbed employees by giving preferential treatment to non-optee ITS officers in BSNL. Secy(T) while appreciating the concern of Forum representatives mentioned that the views expressed by BSNL Unions/Associations will be given due consideration while framing the Cabinet Note and in the best interest of BSNL. To settle the issue, 80% role is to be played by DoT and 20% role has to be played by nodal ministries i.e. DoE, DoP&T, DoP&W, DPE, Group of Ministers and with the approval of Cabinet.

It is understood that DoT is drafting a Cabinet Note for the extension of deemed deputation for  a certain period and for certain number of ITS officers in BSNL/MTNL. This move of DoT further allowing continuation of deputation in BSNL / MTNL will be protested orginisationally and legally.

  • The Forum leaders requested the Secretary (T), DoT to give early approval for the BSNL's proposal of 78.2% IDA Pay fixation. The Secretary (T) told that it is being looked into.

  • The leaders enquired about the status of the TRAI's recommendation to provide financial assistance to BSNL in view of to compensate BSNL's  deficit in providing Telecom Services in Rural parts of the Country, the Secretary (T) told that the same is being processed.

  • Regarding refund of BWA Spectrum Charges to BSNL: Forum requested for immediate refund of  BWA spectrum Charges to BSNL. Secy(T) mentioned that BSNL has proposed to surrender BWA Spectrum and that is being looked into.

20.09.2012: GS, AGS(HQ), GS, President SNEA(I) and Vice President AIGETOA met Director(HR) and discussed

  • Delay in holding of Joint Committee Meeting: We expressed our concern against non-holding of Joint Committee meeting to discuss the issues i.e. CPSU Cadre hierarchy, Finalization of E-2 & E-3 standard IDA pay scales for JTO and SDE equivalent executives andRecruitment of Sr. DGM etc. Director(HR) immediately spoke to PGM(SR) Chairman Committee and directed him to hold immediate meetings to submit the Committee report as early as possible.

  • Recruitment of 162 DGMs: We strongly protested against arbitrary notification of 162 DGMs recruitment in Telecom Operations and Telecom Finance wings wherein all existing BSNL executives have been debarred to appear in the DGM Online examination on the pretext of age, qualification and grade etc. Director(HR) after detailed discussions assured to look into the matter.

20.09.2012: GS, AGS(C/E/Arch/TF) and AGS(HQ) met Sr. GM(Pers.) and discussed

  • CPC from DE Adhoc to DE Regular Promotion: We requested to expedite CPC for filling up of all vacant DEs posts on regular basis. Sr.GM(Pers.) mentioned that the CPC is in progress for DE Regularisation upto undisputed list no.-5 of SDE(T) and shortly it will be completed. We also requested that BSNL should take immediate steps on SDEs Seniority list no. 6 as per Hon'ble Court direction so that stalemate created is removed. Sr. GM(Pers.) assured to re-examine the case further.

  • Restructuring of AD(O/L) Cadre: Sr. GM(Pers.) mentioned that Committee headed by Addl. GM(Estt.) has not submitted the report on this issue. However, he assured for an early clearance.

  • CPC to fill up SDE(T) vacant posts of seniority-cum-fitness quota: Sr. GM(Pers.) mentioned that a letter for seniority-cum-fitness quota has been sent to DoT. After receiving the reply the CPC will be initiated.

  • DPC for Offtg.SDE to DE:- Sr.GM(HRD&A) intimated that DPC is almost complete & orders will be issued soon.
  • Reliving of JTOs Barmer:- Sr.GM(HRD&A) intimated that CO is considering some alternate arrangements.
  • Declaration of new Unpopular Station:- Sr.GM(HRD&A) intimated that the case is under consideration.

19.09.2012: GS, President, AGS(C/E/Arch/TF) met PGM(BW) and discussed:

  • Filling up of the vacant SDEs(Civil) Posts: They expressed our resentment against non-filling up of the vacant SDEs(C) posts for the last two years on the pretext of pending court cases on JTOs All India Seniority  list. They requested to fill up vacant SDEs(Civil) posts by holding immediate CPC from the existing JTOs All India seniority list since no stay order is granted by Hon'ble Court, subject to outcome of the court cases. PGM(BW) after detail discussions assured to expedite CPC from JTO(C) to SDE(C) and also assured to re-examine the sanctioned strength of SDE(C) on the basis of DoT RRs.

  • Consideration of request/tenure transfer of SDEs/EEs(C) Wing: They requested for early issuance of request/tenure transfer cases of SDEs/EEs(C) wing. PGM(BW) informed that as per our earlier meeting and discussions, the proposal of 13 SDEs(C) request/tenure transfers  has been prepared and sent to the competent authority for approval & shortly the transfer orders will be issued.

  • Relieving of SDEs/JTOs(C) wing on deputation to other Govt. departments or PSUs: They expressed our concern against not allowing SDEs/EEs(C) on deputation to other Govt. departments and PSUs since BSNL don't have much Civil work. PGM(BW) informed that it has been accepted to allow deputation and about 11 applications of JTOs/SDE(C) for deputation  has been sent to respective departments and PSUs for their acceptance and for VCRs clearance. However, he assured an early action.

  • Modification in BSNL MSRRs: They requested for processing the case of modification in BSNL MSRRs allowing Diploma holders JTOs/SDEs to be promoted as EE(C) as per CPWD RRs. They also requested that while allowing Diploma holders having 10 years experience in engineering work for EEs promotion the seniority already given to degree holder should remain unchanged.

13.09.2012: Hon'ble High Court Kerla at Ernakulam  interim order on 147 SDEs (LDCE Quota) case:   Case came up for hearing today in the evening , Due to lack of time, Case was adjourned to 24/09/2012 .

12.09.2012: Felicitation of the CMD & submission of Memorandum during his visit to Jaipur: Hon'ble Shri R.K.Upadhyay CMD, BSNL had an one day visit at Jaipur he had a very busy schedule yet he spare 20 minutes for the associations. Com. M.K.Morodia, Circle Secretary along with Com. H.L.Awasthi, Circle President, Com. Karan Singh, CHQ advisor and other Circle Office Bearers & Branch Secretaries stationed at Jaipur attended the meeting. Com. M.K.Morodia, CS presented Bouquet and submitted the Memorandum to the CMD while Com. H.L.Awasthi, Circle President, Com. Karan Singh, CHQ advisor presented a memento to the CMD, other Circle Office Bearers & Branch Secretaries of AIBSNLEA also presented a rose to the CMD, CMD took their introduction too. Shri R.K.Upadhyay was very pleased by such type of felicitation made by AIBSNLEA Office Bearers. 12.09.2012: GS, President, FS ,CS Delhi Circle met Director(HR), BSNL and discussed:

  • Settlement of pending HR issues of executives: They requested for early settlement of pending HR issues and the issues related to viability of BSNL as discussed in CWC meeting of AIBSNLEA held at Ahmedabad on 23rd & 24th August 2012 and submitted in the form of resolutions. Director(HR) mentioned that he has gone through our resolutions letter and marked to PGM(SR) for further necessary action. However, he assured to look into all the issues.

  • CPC from EE(E) to SE(E): They requested  for the approval of CPC conducted for promotion from EE(E) to SE(E). Director (HR) after some discussions assured for an early approval.

  • Ante dating of DNI of seniors w.r.t their junior executives: They expressed our resentment against the indifferent attitude of the committee members for giving a negative report on this issue. They explained the provisions of 6th CPC recommendations to remove the pay anomaly by giving increments twice in a year i.e. on 1st January and 1st July of the year but such provision is not being adopted in BSNL. They requested that seniors pay should be stepped up w.r.t his junior, DNI date and further the DNI of senior executive should be restored on his due date of DNI, it will avoid the pay anomaly. Director (HR) assured to further discuss the matter with the members of the committee.

12.09.2012: GS, President, FS, CS Delhi Circle met GM(FP), BSNL CO and discussed:

  • Consideration of left out cases of AOs for CAO promotion: They requested for early issuance of promotion order of left out cases of AOs  to CAO promotion due to delay in receiving VCRs etc.,. GM(FP) assured an early action.

  • Modification of CAOs posting orders on promotion on genuine grounds: They requested for consideration for modification/cancellation of transfer & posting orders issued of CAOs on tenure basis and on promotion. GM(FP) assured to examine all the cases given by this Association.

  • Request /tenure transfer of AOs: They requested for early consideration of request/tenure transfer of AOs. GM(FP) assured that all pending request applications and the tenure station transfers of AOs are under consideration and shortly transfer orders will be issued. 

  • Request transfer of JAOs under Para 9: They requested for early consideration of request of request / tenure transfer of JAOs. GM(FP) assured that all pending request applications of JAOs under Para 9 are under consideration and within a month transfer orders of JAOs will be issued.

12.09.2012: GS, President met Sr. GM(Pers), BSNL CO and discussed:

  • DPC from DE to DGM: Sr. GM(Pers) mentioned that CPC process to fill up 386 DGM posts have been completed but the promotion order will be issued after the final judgment of Hon'ble Ernakulam High court decision on 147 SDEs of LDCE quota seniority case. However he informed that 147 SDEs seniority case has been listed for hearing yesterday in the Hon'ble Ernakulam High court but could not be heard due to some emergency cases. Now, it is expected tomorrow for hearing.

  • DPC from SDE(T) to DE(Adhoc/Regular): Sr. GM(Pers) immediately spoke to Sr. GMTD, Jabalpur for submitting  an application to Hon'ble CAT, Jabalpur for an early hearing. Sr GMTD, Jabalpur assured to discuss the matter with BSNL's advocate for an early date of hearing. After the stay order is vacated, then only DPCs for promotions from SDE(T) to DE(Adhoc/Regular) will be issued.

  • Consideration of pending request/tenure transfers: They requested for early relieving of SDEs(T) from hard tenure circles to their parent Circles. Sr. GM(Pers) assured to look into the matter.

11.09.2012: Implementation of 78.2% IDA fitment benefit: GS, President met Director(PSUs) DOT for early processing the 78.2% IDA fitment pay fixation case of BSNL employees sent by BSNL Board for the approval of Competent Authority and issuance of Presidential directive. Director(PSU) confirmed that BSNL Board's approval on 78.2% IDA fitment has been received and it will be shortly processed for approval of the Competent Authority. It is understood that the proposal after clearance from DoT Finance Cell and Pension Cell, it will be sent to the Competent Authority for approval. 

11.09.2012: GS, President met Sr. DDG(BW) DoT and discussed:

  • Regularisation of Adhoc EEs(Electrical) Wing in DoT prior to their absorption in BSNL: They requested for filling up of the vacant EEs(E) posts on regular basis by implementing SC/ST roster point properly prior to the year 2003. Sr. DDG(E) after detailed discussions assured that he will examine the DPC proceedings of year-2003 for EEs regularization. After absorption of Group-'B' level officers in BSNL, the DPCs for regularization of adhoc EEs should have been conducted on the basis of DoT RRs till the BSNL finalize its own RRs.

  • Allowing option upto 01.10.2004 instead of 31.03.2004 on 2nd ACP benefit to SDEs(C) having diploma qualification: They requested for allowing option to SDEs(C) of 2nd ACP benefit upto 01.10.2004 instead of 31.03.2004 as per the provision of EPP. Sr. DDG(BW) DoT mentioned that as per the administrative order the 2nd ACP benefit to diploma holder SDEs(C) was allowed upto 31.03.2004 which now can't be reconsidered and already court case is pending on this issue.

11.09.2012: Status of 78.2% IDA fitment to BSNL employees: GS, AGS(HQ) met GM(Estt.), BSNL C.O. and enquired about  the status of 78.2% IDA fitment proposal approved by BSNL Board and its approval from Competent Authority. GM(Estt.) informed that 78.2% IDA fitment benefit proposal after BSNL Boards' approval has been sent to DoT today morning for the approval of Competent authority and issuance of Presidential Directive. The receipt of proposal from DoT has also been confirmed.

10.09.2012: GS, President, FS met CMD, BSNL and discussed:

  • Promotion from EE(E) to SE(E): They requested for early issuance of promotion order from EE(E) to SE(E) since the CPC has been completed on 30.08.2012 itself. CMD assured to look into the matter.

  • CPC from DE to DGM: CMD expressed unhappiness towards several pending court cases which have stalled the promotions. The DGM promotion is also held up for want of the clarifications from Hon'ble Ernakulam High Court, however CGMT Kerala Circle has requested for early hearing to the Hon'ble High court. CMD also mentioned that DEs on promotion to DGM are declining promotion to distant Circles is not appreciable. Hence, he feels that before DGM promotion executives should be interviewed for distant Circles postings. They clarified that only those executives on DGM promotion are declining promotion to distant Circles who are retiring within two years period. But DEs having more than three years service are opting posting to distant Circles.

  • Absorption of ITS Officers in BSNL: They expressed our serious concern against non-completion of ITS Officers absorption process in BSNL. CMD mentioned that BSNL along with DoT & MTNL are going to Hon'ble High Court Delhi on 30.09.2012 to explain the situation. It is understood that BSNL Management is going to plead for continuation of ITS officers on deputation basis ignoring the discrimination towards absorbed employees of BSNL. They have to organizationally and legally protest against discrimination of BSNL employees.

07.09.2012: Souvenir of 4th Circle Conference is inaugurated: GS, Com. Prahlad Rai has inaugurated "Souvenir" in the memory of 4th Circle Conference, at Alwar (17th-18th March'12) in a grand programme organised by Rajasthan Circle at Conference Hall, PGMTD Campus. Most of the Executives Body members of all the 4 branches at Jaipur and CEC members at Jaipur along with several active comrades were present on this occasion. Circle President Com. H.L.Awasthi & then after Vice President Com. N.L.Sharma, presided over the function & Com. Karan Singh, CHQ Advisor also Graced the occasion. 

Com. R.C.Sharma, Chairman, Souvenir Committee presented the packet of Souvenir for inauguration to Com. Prahlad Rai and Com. Com. Karan Singh, CHQ Advisor, Circle President Com. H.L.Awasthi and Circle Secretary, Com.M.K.Morodia supported him in inauguration.

Com. H.L.Awasthi, President delivered welcome Speech and appreciated the sprit of Com. Prahlad Rai towards the Association.

Circle Secretary, Com.M.K.Morodia elaborately apprised the meeting that always a top priority is given by the General Secretary to the issues related to Rajasthan Circle and its Comrades.

General Secretary, Com. Prahlad Rai in his detailed & graceful address covered all the burning issues. He also apprised the meeting about future planning on the important issues of the association. Com. Prahlad Rai appealed the comrades of Rajasthan that they should work Harder & Harder to strengthen the viability of BSNL. Com. 05.09.2012: GS, President, FS met GM(FP) and extended sincere thanks for issuing timely 475 CAOs promotion order & discussed

  • DPC from AO/CAO(Adhoc) to CAO (Regular): They requested to hold DPC from AO/CAO(Adhoc) to CAO on regular basis. GM(FP) mentioned that DPC has already been initiated to fill up about 250 CAOs posts on regular basis.

  • DPC from CAO to DGM(F): They requested to expedite DPC from CAO to DGM(F) & to consider regularly promoted CAOs for promotion by giving one time relaxation. GM(FP) agreed that some more CAOs ACRs/VCRs will be called shortly for DPC.

05.09.2012: GS, President met GM(Estt.) and discussed regarding:

  • Pay anomaly case of JAOs joined after 07.05.2010. GS(Estt.) mentioned that the Committee has submitted its report to provide five additional increments benefit to Deptt. JTOs/JAOs to remove the pay anomaly. The MC Memo has been prepared & will be sent to next MC Meeting & thereafter to BSNL Board for approval. They expected that within 2-3 months time, the issue will be resolved. They also requested to allow to exercise the option for pay fixation to Deptt. JAOs/JTOs who joined after 07.05.2010. GM(Estt.) assured to re-examine the case.

  • Implementation of 78.2% IDA fitment benefit: GM(Estt.) informed that BSNL Board decision on this issue is expected to be received from Sr. GM(Legal) Section shortly. Thereafter it will sent to DoT for the approval of the competent authority.

  • Anomaly due to accrual of increment of Junior earlier than the senior after fixation of pay in revised pay scale implementation of 2nd PRC: They requested to express our serious concern against the negative report submitted by the Committee to the competent authority whereas 6th CPC has already issued order to fix up the pay of Govt. employees twice in a year i.e. 1stJan/1st July and one additional increment benefit has been given in the pre-revised pay scale whose DNI lies in between Feb. to July. Accordingly the pay has been fixed for ITS officers in BSNL & arrears were drawn immediately. But the BSNL executives antedating/stepping up of pay w.r.t. juniors is not being settled. However, They will further take up the case with the competent authority not to accept negative report of Committee.

04.09.2012: FORUM OF BSNL UNIONS / ASSOCIATIONS- Decisions of the Meeting of the Forum held on 4th September 2012: A meeting of the Forum of BSNL Unions / Associations was held on 4th September 2012 at BSNLMS Office. Com. C. Singh, GS, NFTE, Presided. Com. V. A. N. Namboodiri, Convener, briefed about the developments after the last meeting, including the discussion with CMD and Joint Secretary, DoT. All comrades actively participated in the discussion. Com. GS and President attended the meeting. The following decisions were taken unanimously:

  1. Issues of 12th June Agreement: The meeting expressed its appreciation to the CMD and management for getting approved the 78.2% IDA fitment benefit in the BSNL Board meeting. Forum should pursue the case effectively so that the orders are got issued before BSNL Day ie. 1st October 2012. They should take effective steps for getting the Child Care Leave implemented as per agreement. The Forum should demand the re-constitution of the committee with representatives from executive and non-executive unions on the superannuation benefits to the BSNL recruitees as agreed by the management.

  2. Meetings with Management: The Meetings with the management should be got fixed sufficiently early so that all unions can be intimated and participated.

  3. ITS issue- Lunch Hour Demonstration on 18th  September 2012:The present position of ITS absorption was reported by the leaders of SNEA(I) and AIBSNLEA, who had met the Secretary, DoT and had detailed discussion. The DoT seems to be preparing a Cabinet Note for deemed deputation for further period of time. The meeting of the Forum strongly objected to any further extension. The meeting decided to organize Lunch Hour Demonstration on l8th September'2012 demanding immediate implementation of repatriation of ITS, to be followed by further agitational programme. A letter jointly signed by the Unions/Associations will be served to the management. It was also decided to resort to legal action in the matter, as and when necessary.

  4. Agitational programmes by Central trade Unions: The decision of the National Convention of Workers held on 04-09-2012 at New Delhi organized by the Central trade Unions was reported. The Convention has called upon the workers to organize a Two Days Countrywide Strike on 20th and 21st of February 2013 and other agitational programmes on the major demands of the workers in continuation of the 28th February 2012 strike. The matter will be further discussed in the next meeting.

03.09.2012: GS, President, AGS(HQ), CS Delhi Circle met Secy(T), DoT along with GS and President SNEA(I) and discussed:

  • Absorption of ITS Officers in BSNL: They expressed our serious concern against non-completion of ITS Officers absorption process in BSNL/MTNL due to the continuous opposition of ITS Officers. DoT has initiated absorption process 3-4 times but majority of ITS Officers have not exercised option in BSNL/MTNL on one or the other pretext. They requested to implement Hon'ble High Court Delhi's judgment to repatriate on-optee ITS Officers upto 30.09.2012 and give responsibility to absorbed Group-'A' officers to man the operation and maintenance. They also mentioned that immediately there will not be any problem in BSNL/MTNL on repatriation of non-optee ITS officers. They categorically told that as per Govt. of India Policy of restructuring of BSNL/MTNL from Govt. Deptt. to Corporate entities and  absorption of 4.0 lacks employees in BSNL/MTNL, the absorption process of ITS officers should have been completed and closed. Then only the certainty will prevail. DoT should not feel that absorbed employees in BSNL/MTNL are contended and only the ITS officers are discontented. Hence, no preferential treatment  to non-optee ITS Officers should be given by making separate rules, otherwise there will be unrest in the BSNL/MTNL against this discrimination. DOT should immediately end deputation in BSNL/MTNL or revert back all BSNL/MTNL employees to DOT. Secretary (T), DoT in  the presence of Addl. Secretary (T), USO Administrator, Member (S), Member (T), Joint Secretary (T), Joint Secretary (Admn.), Deputy Secretary (Absorption Cell) and other Senior Officers of DoT, gave patient hearing to us and mentioned that delay in absorption process is not at all good administratively as well as  legally and now it needs completion in the interest of BSNL/MTNL. He also mentioned that seeing the ruling position and BSNL/MTNL viability, appropriate decision will be taken shortly. He assured to examine the contingency plan submitted by us. During discussion Secretary (T) repeatedly told that BSNL/MTNL interest will be safeguarded while taking any decision of ITS Officers absorption issue.

It is understood that DoT is thinking to extend deputation of ITS officers in BSNL/MTNL, which  will be strongly protested by BSNL/MTNL Unions/Associations

  • Payment of pension contribution on actual basis instead of maximum of the IDA pay scale: They requested to change the payment of pension contribution on actual basis instead of maximum of IDA pay scale. Secretary (T) while discussing with Member (S) mentioned that the issue has been taken up with the DOE and efforts are being and to get the clearance.    

  • Periodic pension revision of BSNL Pensioners: They requested for issuing order for periodic pension revision of BSNL pensioners after 3rd and 4th PRC reports also. Member (S) mentioned that even Central Govt., has not issued periodic pension revision order for Govt. employees and DPE has already objected earlier IDA pension revision order of BSNL pensioners. They replied that DPE is no way dealing with the Govt. pension rules, since no Govt. pension exists in other PSUs. However, Secretary (T) told that, nothing can be mentioned on this issue at this stage.

31.08.2012: United Forum of BSNL/MTNL Executives' Associations comprising AIBSNLEA, SNEA(I), AIGETOA, MTNLEA, TEAM representatives met and discussed the ongoing developments regarding absorption issues of ITS officers in BSNL/MTNL. They expressed their serious concern against DoT/BSNL/MTNL move to allow continuation of deputation of ITS Officers in BSNL/MTNL. As per Hon'ble High Court Delhi the non-optee ITS Officers should be released by Sept'2012 but BSNL/MTNL Managements have not finalized any contingency plan till date rather making efforts continuation of ITS Officers on deputation to BSNL/MTNL. The following decision are taken:-

  • To start protest actions against DoT/BSNL/MTNL move to allow continuation of deputation in BSNL/MTNL in coordination with non-executives Unions shortly.

All the Circle/Branch executives are requested to keep organizationally ready to protest against partition attitude of the Govt.

31.08.2012: Congratulations! AIBSNLEA's Consistent efforts yielded result in getting released the promotion, posting & transfer  order of AOs/Sr AOs to 475 CAOs(Adhoc). 31.08.2012: GS met PGM(BW) and discussed

  • Regular Promotion from JTO(C) to SDE(C): They requested to expedite DPC to fill up DPC from JTO(C) to SDE(C) to remove stagnation in JTO(c) cadre. JTOs(C) of 1989 recruitment year and having 23 years of service are still waiting for their first functional promotion. PGM(BW) mentioned that DPC process has been initiated but due to some seniority related issues it is being delayed. However, he assured to resolve  the issue at the earliest & expedite DPC.

  • DPC from EE(C) to SE(C) on regular basis: They requested to hold early DPC from EE(C) to SE(C) on regular basis. PGM(BW) informed that efforts are being made to hold DPC before 15th Sept'2012 since Chairman DPC is occupied with other work.

  • Consideration of request transfer cases of SEs/CEs: They requested to consider some genuine transfer cases of SEs(c) and CE(C). PGM(BW) assured to look into the cases.

30.08.2012: GS, AGS(HQ) met Sr. GM(Pers.) and discussed:

  • DPC from DE to DGM: They expressed our serious concern against delay in issuance of promotion order from DE to DGM. Sr. GM(Pers.) mentioned that BSNL C.O. Pers. Cell has requested to CGMT, Kerla Telecom Circle, Trivendrum for filing an application before Hon'ble High Court of Kerala for an early hearing in WP(C) 26226/2010 and connected cases(147 SDEs of LDCE quota seniority case). As soon as the final judgment is delivered by Hon'ble Ernakulam High Court the promotion order from DE to DGM will be issued to fill up about 400 DGM posts.

  • DPC from SDE to DE: They requested to talk with Sr. GMTD Jabalpur for an early hearing date from 24.09.2012 for getting vacated the stay order from SDE to DE promotions. Sr. GM(Pers.) assured for sending a letter to CGMT, MP Circle and speak over telephone in this matter.

30.08.2012: GS, President met ED(Fin.), BSNL and requested for clearance of CAO DPC and sending to the Competent Authority for approval. ED(Fin.) immediately cleared the DPC minutes and sent to Director (Fin.) and  Director (Fin) also cleared  immediately and sent to Director(HR) and shortly it will go to CMD, BSNL for approval. After the approval of DPC minutes by Competent Authority the posting on promotion order from AO to CAO to fill up about 550 CAOs posts will be issued shortly.

30.08.2012: GS, President, FS met GM(FP) and discussed:

  • DPC from AO to CAO: They requested for early issuance of promotion order from AO to CAO. GM(FP) mentioned that DPC has been completed to fill up about 550 CAOs posts and minutes has been sent to the Competent Authority  for approval. After the approval of DPC by the Competent Authority, the posting on promotion order will be issued shortly. He also assured to accommodate CAOs on promotion in the same Circles where the vacancies are available.

  • DPC from CAO to DGM(F): They requested to expedite DPC from CAO to DGM(F) . GM(FP) mentioned that DPC process has been initiated to fill up vacant DGM(F) posts.

  • JAO to AO DPC: They requested to complete the DPC process of JAO to AO. GM(FP) mentioned that DPC process is going on but some below bench mark cases are yet to be  resolved and the efforts are being made to get the stay order vacated from Hon'ble Chandigarh CAT.

  • Postal JAOs promotion to AO: GM(FP) assured to consider Postal JAOs absorbed in BSNL also for AO promotion and their confirmation, subject to outcome of the Court cases.

24.08.2012: Central Working Committee meeting of the AIBSNLEA held on 23rd and 24th of August'2012 at Ahmedabad: The Central Working Committee meeting of the AIBSNLEA held on 23RD and 24TH OF August at Ahmedabad. The meeting commenced at 9.30 hours at Funpoint club, Hotel Dev Comfort, Near Gujarat High Court, SG Highway, Ahmedabad, Gujarat with hoisting of Association flag in the presence of Central Head Quarters office bearers, Circle Presidents, Circle Secretaries, Special invitees and CWC members from all over the country.

Com. P. Venugopal, President AIBSNLEA CHQ in his speech informed that BSNL is in a critical situation. BSNL is expected to face around 8800 crores as loss. He stated that only when BSNL flourish, our life will flourish. He suggested that instead of making complaints of non availability of stores, the old materials to be recovered from the customers to meet the requirement. He requested both the Directors to look into the availability of stores. BSNL is spending more than the earning as on today. He expressed that the discussions in the CWC will bring some valuable suggestions in overcoming the situation. He thanked the Director (HR) for handling the situation during the last strike call. He stated that both the Directors will help in getting 78.2% IDA fitment. He reminded that only after the introduction of GSM service by BSNL, the tariff has been reduced to paise rate. Regarding the case of Option and 5 increments issue of Departmental JAOs for which a committee has been appointed, he requested Director (HR) to extend the option to departmental JAOs and also the issue of Juniors drawing high pay than seniors.

Delegates in this CWC Meeting represents 25,000 strong BSNL executives, have come to attend this Meeting from every nook & corner of the country-from. Thus, this CWC Meeting has given us a unique opportunity to discuss the issues related to the growth of BSNL which gives us bread & butter and also to discuss the issues related to our career prospects.

G S informed that Director (HR) Shri A N Rai has played vital role in handling the 78.2% IDA fitment.

He stated that All India BSNL Executives' Association formally launched on 1st May 2004 by merging ten separate Associations which were earlier representing Group-'B' and promotee source Group-'A' officers of different disciplines in the Department of Telecommunications. AIBSNLEA members belonging to various disciplines of BSNL i.e. Telecom Engineering, Telecom Finance & Accounts service, Telecom Civil, Electrical and Architectural, Telecom Factory Engineering Services, Telecom Personal Staff, Corporate Office Secretariat Staff, Telecom Official Language Officers etc., numbering more than 25,000 throughout the country, are playing the pivotal role in the development, maintenance and operation of Telecom.

He stated that at the time of formation of BSNL from a Govt. Department to a corporate entity, BSNL faced unique challenges, in which serious doubts were raised about its capability to sustain productivity and profitability. But with true grit determination, dedication and sincerity, BSNL has belied these misconceptions and sustained its position. In a period of 12 years, BSNL has Wireless customer base of about 98 million, Wired line customer base of 22 million and 9 million Broadband connections have been provided in this period. This year is a very challenging year for us to improve its position since in last three years, BSNL has faced losses of about Rs.1800 Crores, 6300 Crores and 9000 Crores respectively. We are confident that under the leadership of Shri R.K. Upadhyay, CMD, BSNL, we will be achieving the targets set by the Govt.

Over the past 12 years, assets of BSNL have grown almost double. with an assets base of about 68,000 crores at the time of its formation, now the asset base has become more than 1,36,000 crores. BSNL's target for this financial year is to provide about 1.1 million telephone connections including those in rural areas but in the area of Landline telephones, lot of disconnections are taking place and our market share declined which is a matter of serious concern to all of us. He reassured best co-operation and support of AIBSNLEA to Hon'ble CMD in achieving the targets set by the Government to turn around BSNL.

He stated that AIBSNLEA is holding its CWC Meet when big changes in Telecom Sector are in the offing. In the rapidly changing scenario in Telecom, the regulatory regime and competition in Telecom are a fait accompli. He also stated that AIBSNLEA and its members are not afraid of any competition. With all the constraints around, our colleagues in BSNL in all major cities and other places are facing competitions with exemplary courage. In a bid to fall in line with the international standards, the Telecom Regulatory Authority of India has proposed certain standards to be ensured for quality of service along with provision of imposing penalties, if the prescribed quality of service is not maintained. Technological innovation, the rise of the customer-driven markets and regulatory actions are dictating new management styles. Now, there is pressure on us not only to increase DELs i.e. number of telephone connections but also to retain the customer base, especially the creamy layer by rendering quality service & good customer care.

He also stated that the Govt., based on TRAI recommendations, has completely phased out the Access Deficit Charges (ADC) by 31st July'2011. He pointed out that it was assured that BSNL would be suitably compensated in the form of ADC for meeting the obligations in respect of rural telephony or other un-economic services but the same has been withdrawn. It seems that the Govt. is heading towards limiting its commitment to a short period.

He mentioned that BSNL is the major service provider of universal services in rural, remote, in-accessible and hilly areas, provided reliable service connectivity across the country including ice-lands, should be fully exempted from making the contribution towards USO fund and the net contribution made by it till date which is about Rs. 8000 Crores should immediately be refunded to BSNL.

He stated that National Telecom Policy (NTP)'99 does not envisage recovery of any license fee from BSNL (then DoT) in respect of its fixed line services. In respect of GSM line services the license fee was to be paid by BSNL but the same was to be fully reimbursed being a national service providers having immense rural and social obligations. BSNL has been paying the license fee in respect of basic services and cellular services also. Accordingly, BSNL has suffered a total financial loss of about Rs. 24,000/- Crores up to 31.03.2012. Further it is facing the recurring financial loss of Rs. 1200 Crores per annum on the payment of license fee and Rs. 1750 Crores towards USO contribution per annum contrary to NTP'99.

He stated that recently Union Cabinet approved the National Telecom Policy -2012 (NTP - 2012) on 31.05.2012. The Cabinet also approved introduction of Unified License and authorised the Department of Telecommunications to finalise the new Unified Licensing regime with the approval of Minister of Communications & IT. The policy will certainly benefit the Private Operator but nowhere any preferential treatment to BSNL/MTNL has been offered being the State own PSUs. The merger and acquisition policy should not be for enabling trade in license and spectrum by the unscrupulous players quick profits.

He pointed out that BSNL has requested to DoT for financial support in order to make its wired line services/rural telephony financially viable by compensating the losses of Rs. 44,000 Crores incurred by BSNL due to difference in ADC admissible to BSNL, payment from USO fund against difference of rentals set by TRAI and the rental being charged by BSNL for the rural DELs provided through USO scheme. The operational expenditure of about Rs. 5000 Crores per annum of its 75 lakh rural lines and reimbursement of Rs. 600 Crores annual losses being faced by BSNL on telegraph services but the Telecom Commission has only reduced USOF contribution from 5% to 3% which gave very small amount relief to BSNL.

He pointed out that Govt. has charged Rs. 18,500 Crores for 3G and BWA spectrum auction and as per the allocation guide-lines in which BSNL has been given one block of spectrum on the cost of highest bid in the respective service area, whereas BSNL should have been allocated 3G and BWA spectrum free of cost in lieu of complete phasing out of ADC or on benchmark price and demanded immediately refund Rs. 8313 Crores of BWA Spectrum Charges to BSNL.

He mentioned that BSNL should expand its GSM, 3G and Broadband Services looking into tremendous public support and demand. BSNL Management's decision to outsource CDR billing, its improper implementation and Annual Maintenance Contracts for the New Technology Switches has became the source for drainage of hard earned revenue. All these days, BSNL's own employees were successfully carrying out these jobs.

Recently BSNL Management has decided that cities/ urban areas having very good potential for CFA revenue should be identified and special focus should be given for making TNF areas technically feasible so that various services like land-line, broadband, leased circuits etc. can be provided on demand in these cities. Accordingly, top 41 SSAs in terms of revenue and 4 SSAs in NCR have been identified due to their importance; the NCR towns i.e. Ghaziabad, Noida, Gurgaon and Faridabad have been included in the list. Its true implementation will certainly increase the revenue of BSNL.

He stated that the AIBSNLEA and its members acknowledge the comments of CMD BSNL Shri R.K. Upadhyay that "The need of the hour is to approach the customer right at his doorstep rather than waiting for the customer to approach us. Only a personalized service to the customers can help us tide over the growing trend of customer churn. Let us start thinking like a businessman and bring professionalism in our approach and behavior".

He also stated that the AIBSNLEA and its members acknowledge the comments of Director (EB/HR), BSNL Shri A.N. Rai that "improving the work culture and public interface to improve our image. He is also stressing on the need of an attitudinal change for making customers delighted and to improve the marketing strategies, so that, more and more customers are attracted".

He stated that the AIBSNLEA also acknowledge the comments of Director (CM) Shri R.K. Agarwal that "for making the customers delighted by providing quality service and to stress upon making value added services more popular. Also to give wide publicity to BSNL Special Plans in pushing up the growth of new connections, this will result in higher revenue from the services."

He informed that AIBSNLEA in its true spirit acknowledge the comments of Director (CFA), BSNL Shri N.K. Gupta that "BSNL's wireline customer base and its revenue are shrinking day by day in spite of providing required store materials such as CLIP instruments and U/G PIJF cable etc. by Corporate Office, which is a matter of serious concern to all of us".

He mentioned that AIBSNLEA members also acknowledge the comments of Director (Finance), BSNL Shri K.C.G.K. Pillai that "Stressing on the need of an attitudinal change for making customers delighted to continue with BSNL. All out efforts are required to earn more & more revenue by providing quality service".

GS also stated that despite having a definite edge over the Private Operators in many areas, BSNL has some weaknesses too. The main weakness lies in its structure itself i.e. the Management believes and possesses a work culture which does not suit the need of the hour. There is no denial that the dependency on other Departments / Organizations like Planning Commission, Department of Electronics, Department of Expenditure, Department of Telecommunications and Department of Public Enterprises delays the decisions. BSNL has to be given the freedom to decide its own issues. After all, it is the BSNL Management which is responsible and accountable to the Public whereas others are not. In this background, BSNL needs to be given the full autonomy in decision making both on functional and financial front. In the process of decision making, innovative ideas and bold initiatives need not be distrusted and overcome by the age old DoT systems and procedures of ensuring safety and propriety.

GS pointed out that in the modern management concept, it is also necessary to decentralize the administrative and financial powers for not only reducing the burden on the top management but also to give adequate freedom to the lower formations. Unfortunately, a typical DoT work culture is still continuing in BSNL, which tends to keep the powers centralized and prevents any move in positive direction. The BSNL again suffers most in the absence of a sense of team spirit. The conviction of team leaders to live in isolation keeps them away from the realities. In the challenging current business scenario with highly competitive market conditions and customer expectations in terms of quality of service, BSNL will have to gear up itself to improve its performance in achieving excellent growth in all spheres. Accordingly, BSNL needs to take immediate steps to motivate its works force, their skills and profile through trainings, seminars, moral education and attractive incentive schemes etc. so that it meets the challenges and increases its profitability in future and also prevents the brain drain. General Secretary strongly mentioned that as a Service Association, AIBSNLEA can't remain as a silent spectator to the problems of our cadres. As already stated, our members are frustrated due to non-settlement of the various pending grievances:

GS demanded to settle the long pending grievances and demands of the Association like

  1. Filling up of the vacant posts in JAG, STS level Executives posts of all disciplines of Telecom Engineering, Telecom Finance & Accounts, Telecom Factory, Telecom Civil/Electrical/Arch. Engineering Wings, PA/PS, AD(O/L), CSS etc .

  2. Regular Promotion from JTO (T) to SDE (Telecom) and also vacant posts of SDEs/AGMs (Telecom factory)

  3. Serious irregularities in the TES Gr. B officers seniority lists

  4. DPC from AO to CAO and JAO to AO

  5. Holding of DPC for 1999 JAO Batch

  6. Amendment in BSNL Management Service Recruitment Rules-2009

  7. Allow existing executives for MT examination without any age criteria

  8. Expediting the case of Change of designations on each Time Bound upgradation and post based promotions and implementation of CPSU cadre hierarchy assured at the time of absorption.

  9. Finalisation of E1A, E2A, E9A and E9B IDA pay scales

  10. Revision of Date of effect of Implementation of revised IDA Pay Scales for the Executives w.e.f. 1-10-2000

  11. One time placement of SDE to Sr. SDE Grade

  12. Early settlement of Pay anomaly cases wherein senior Executives are drawing less pay than their juniors

G.S. pointed out that various steps are required to be taken by the BSNL for its viability like immediate Absorption of ITS officers in BSNL. He demanded that the absorption issue of ITS officers in BSNL/MTNL is to be resolved immediately, as these non absorbed ITS officers Association are presently working under uncertainty, thereby not concentrating towards developmental and maintenance works there by creating serious stalemate.

GS stated that the Myth of the Privatization/Disinvestment of BSNL being a panacea of all its problems and Privatization/ Disinvestment of BSNL can only help the Government to meet its budgetary deficits because BSNL shall not be allowed to utilize any of the revenue earned by its disinvestment for the growth/ expansion of BSNL, as the dis-investment MTNL a Navaratna Company has not led to any improvement in performance of MTNL or increase in its Market Share.

G S also pointed out that VRS approved by BSNL Board on 04.10.2011 and the same was sent to administrative ministry (DoT) for its consideration. GS stated that AIBSNLEA strongly oppose such move of VRS to One Lakh employees without having any roadmap that in what way it is going to benefit BSNL.

GS demanded to exemption for BSNL from payment of Illogical interest and taxes.

He also demanded that suitable instructions to all Govt. Departments/Autonomous Bodies where the Govt. of India bears the cost of telephone expenditure for taking the telecom services from BSNL only to support BSNL may be got it done immediately.

GS also stated that Strengthening of Marketing and Sales units of BSNL is the need of the hour to compete with the other service providers.

GS stated that the Group B and Group A level executives in BSNL are playing crucial role in such a phenomenal growth by BSNL. But the Officers need motivation to perform tirelessly for the growth of the company because only a contended workforce can deliver up to the desired level of customer satisfaction. It is therefore, imperative that the Management settle the HR issues concerning all the executives as enumerated above.

GS also stated the intention of the Association is definitely not to burden you with our cadre problems. GS on behalf the members have assured that all members of AIBSNLEA will strive hard for the better future of BSNL and will all together devote ourselves to the service.

GS while concluding, thanked everyone and all for giving him a patient hearing and at the same time reaffirmed the resolution of Association that our members shall be discharging their responsibilities even in the new environment efficiently and will move forward along with all of you to make BSNL of our dreams, a reality. He also assured to our esteemed customers that this Association will do everything to ensure the best possible telecom services to them.

Shri D N Tripathi, CGM Gujarat Circle, Special Invitee in his speech expressed his happiness for getting an opportunity to work in Gujarat Circle. He stated that what has been heard about Gujarat Circle before joining is difference than the reality. Customers are not leaving BSNL is due to poor service to our valued customers. We have sufficient staff and requested all to extend best services to its customers and at least get it in writing from the customers that the services is satisfactory. He also pointed out that repeated faults are the main cause for leaving the BSNL by the customers. In the coming days BSNL broadband which is the main service and profit of BSNL is going face tiff competition in the broadband service, as Reliance is launching the broadband services through out the country. He requested to think of present rather than talking about future.

Shri R K Agarwal, Director (CM) BSNL Guest of Honor in his speech that during 1996 first wireless network was introduced by Govt with high rate of call and also providing only the service in profit making areas. This has resulted the launch of GSM service in 2002 thereby bringing the tariff to paise level. There was a great success of BSNL in the GSM services. At a later stage BSNL has suffered a lot due to the cancellation of tenders for equipment due to various reasons. He also stated that BSNL being Govt is answerable to various higher authorities which other private service providers need not. He stated that finally with lot of constraints now the tender has been finalised. He also stated that Broadband is the latest revolution in the country. Private operators are expected to launch wireless network and broadband with 4G which BSNL is expected to face the competition. BSNL is resisting the change which affects the BSNL. Change is to be made based on the market condition. The approach for marketing and selling is the need where BSNL is very much weak. BSNL is only 12.5% in the market share. The revenue of BSNL and other service provides if compared with the number of customers, BSNL is not that much less as compared to other service providers. Though there is no much increase in the expenditure, economising various fields related to fuel, AMC there is big scope. He stated that the voice may not be market in the coming days and the source of revenue in the future will be only data. Value added service is the need of the customers in the landline and GSM services which will increase the growth. Customer care is most important. Customer expects personalised service. We have to provide what customer wants rather than whatever we give to them. Full automation with latest IT system is helping the private service providers in achieving the revenue. He also stated that the HR issues are also equal and assured that the approach of Corporate Office will be facilitating the need rather than pointing out the faults. BSNL has to have a policy of having right person at right place. Lot of openness is required rather than keeping everything confidential. We need to create healthy environment by giving incentives to good works and pushing back the poor performers is also required by the HR. BSNL has to start talking about money, as a technocrat only accounts personnel are now talking about money. Instead, every one of us has to start talking about money. Our competence as a technocrat has been recognised by globally. Improvement of network is also essential. First we have to see that our internal customers are satisfied so that they can satisfy the external customers. Winners are those who concentrate on their strength and who do not see their weakness. Losers will only concentrate on their weakness. Finally he has expressed that let us make BSNL as the best spoken language of the country.

Shri A N Rai, Director (HR) BSNL Guest of Honor expressed his thanks for inviting him for the session for and on behalf of the CMD. He congratulated the Gujarat Circle for having such quality arrangement which befitted the BSNL management. He pointed out that Com. Rai has given about 20 points of 10 cadres. He informed that the attitude of the BSNL management as far as the promotional and cadres issues are to try to sort all the problems with the employees benefit in the mind. BSNL management will always address the problems in positive manner. He informed that the biggest problem BSNL management in giving promotion is the Court cases. Court cases are a big embedment. There are many contempt case CMD has to face. Most of such cases are generated because of the fault of the management. He requested the help of the members in resolving the problems. Though individual court cases cannot be stopped, the court cases amongst the group are more critical and requested such groups to sit together and arrive to some solution, so that the BSNL management can settle the issue. He has requested every association to have approach to arrive to a solution. He stated that if we can settle one or more case by this way, it will have a very good impact. Officers are not able to promote even after completing all formalities due to the court case. The leadership of all the association should come together in reaching to a satisfactory solution for such court cases. He informed that the issue of 78.2% IDA fitment is still has to be passed the BSNL Board as the 662 crore is the expected expenditure per annum. Additional 1200 crore revenue needs as against the benefit, failing which getting salary will be delayed after a period of one year. He mentioned that upgrade the knowledge of latest development and technologies is must to provide better service to the customers. We fail to provide and deliver what we have. Ensuring that the money is received against the service provided is required. Cost consciousness needs to be kept in mind of everyone of us. The works are to be got it done by the middle management and higher authorities can only give instructions. Our revenue from operations has been reduced only 1000 crores as compared to previous years. There is a big hope that BSNL will pick up. Expenditure has been increased only about 2%. BSNL is a good position, there will be no reduction in GSM service, Broadband is also available with BSNL. He in case we try hard, the entire BSNL board is of the opinion that, BSNL can take off now. BSNL management is ready to give any benefit provided BSNL have sufficient income.

01.08.2012: GS, President, FS, AGS(HQ) met Director (EB/HR), BSNL & requested to get approval of MC Note on 78.2% IDA fitment benefit as per agreement. Director (EB/HR) mentioned that he will try to discuss the matter in today's MC but due to the direction received from DoT on pensioner issue finding difficulty.

It is understood that DoT has directed CMD, BSNL that since the pension to the BSNL absorbees is being paid under Rule-37A of CCS (Pension) Rules, 1972 by the Govt. of India from its consolidated Fund. As such, BSNL has no power to make any commitments regarding pension. Hence, any commitment made by BSNL without Govt. approval, BSNL alone will be held responsible. In view of these, it is advised to CMD, BSNL to withdraw the commitment mentioned in Para-2 of the agreement with BSNL Unions / Associations regarding applicability of fitment benefit @78.2% w.e.f. 01.01.2007 to the pensioners also.

PGM(E) mentioned that the DPC work is over from SDE(E) to EE(E) & the proposal for posting on promotion to fill up about 41 EE(E) posts has been sent to the Competent Authority for approval. He assured an early issuance of  promotion order. PGM(E) also assured that as soon as DPC from EE(E) to SE(E) is completed the next DPC to fill up vacant EE(E) will also be initiated immediately.

23.07.2012: GS, President, AGS(HQ) met Sr. GM(Pers.) and discussed

  1. DPC from DE to DGM(Engg.):  We requested to expedite DPC from DE to DGM. Sr. GM(Pers.) mentioned that ACRs of eligible DEs have been completed but VCRs from  some Circles are yet to be received. The 147-SDEs of LDCE quota seniority case final hearing is also expected shortly in Hon'ble Kerala High Court at Ernakulam. However, he expected that in the first week of August-2012 the court case may be listed for hearing.

  2. DPC from SDE to DE: We requested to expedite DPC from SDE to DE.  Sr. GM(Pers.) mentioned that DPC work is in progress by collecting ACRs/VCRs for the eligible SDEs for DE promotion but it could not be expedited due to stay order granted by Hon'ble CAT Jabalpur against promotion from SDE to DE, the case is posted for hearing on 25.07.2012 and in case stay is vacated, immediately DPC will be expedited.

  3. Posting on promotion from JTO to SDE(T) of LDCE quota: Regarding  posting on promotion from JTO to SDE(T) of LDCE quota, Sr. GM(Pers.) mentioned that Court case is posted for hearing on 7th August'2012 in Hon'ble CAT Guwahati (Assam) but similar court cases have been filed in 5-6 courts to stop postings by some unsuccessful candidates. He expected that to overcome the court cases, it may take one or two  months time.

  4. Considering of pending request / tenure transfer cases of SDEs/DEs: Sr. GM(Pers.) assured to examine the pending cases for early settlement.

20.07.2012: GS, President, AGS(HQ) met Director (Fin.) & discussed

Implementation of 78.2% IDA Fitment Order: We enquired about the approval of MC Note on 78.2% IDA Fitment benefit. Director (Fin.) informed that MC Note was informally circulated in the MC on 18.07.2012 (Wednesday) for discussion but remains inconclusive. Now this will be discussed formally in the next week MC Meeting for approval. He assured that after MC approval the same will be send in the next BSNL Board Meeting, expected to be held in Augusr'2012,  for approval & thereafter for DoT for approval & issuance of Presidential directives.

17.07.2012: BSNL Management's hasty & arbitrary actions against Trade Unionism - AIBSNLEA protest against: AIBSNLEA strongly protest against BSNL Management's hasty & arbitrary actions against Executives' Association wherein BSNL Management based on the recommendations of the National Commission of Schedule Caste (NCSC) has issued transfer orders of SNEA (I) CHQ/Circle/District level office bearers, contemplating charge sheets, dies-non with break in service who participated in the agitation and not granting meeting to the Association etc instead of making an appeal to the Hon'ble High Court. It seems that BSNL Management found an opportunity to act against the office bearers of BSNL Executives' Association with an indifferent attitude which is being faced by executives in day to day activities now a days.

As an Association the issues of its members against any injustice, harassment is to be protested and during protest it  never observed that any Association is opposing an officer on the basis of caste or  creed but opposing on issue basis only. It is a normal functioning of Unions/Associations. However, if some misunderstanding took place between the executive Association and the Officer concerned that should have been settled by the senior level officers available. But in this particular case, such approach seems to be missing which allowed the NCSC to give such judgement.

11.07.2012: GS writes to Shri R.K. 11.07.2012: GS, President met GM(Estt.) and discussed

  1. Implementation of 78.2% IDA fitment order: We requested for early submission of MC Note on 78.2% IDA fitment benefit as per the agreement. GM(Estt.) mentioned that MC Note has been finalized by Estt. Section and sent to EF Cell for clearance and after the approval of Competent Authority it will be sent to MC for approval.

  2. Pay anomaly case of departmental JTOs/JAOs: We expressed our serious concern against non-settlement of the pay anomaly case of departmental JTOs/JAOs. We requested that the pay anomaly of departmental JTOs/JAOs needs immediate settlement by allowing option to them and allowing 5-increments benefit to bring them in the minimum of the E-1A pay scale of JTO.

  3. Antedating of DNI and to removal of pay anomaly wherein seniors are drawing less pay then their juniors:  We resented that despite the direction of CMD / Director(HR), BSNL  and Hon'ble High Court Kerala at Ernakulam judgment the pay anomaly cases are not being settled. GM(Estt.) mentioned that the Committee meetings to discuss above issues could not be held for the last one and half month due to continuous leave of GM(EF) and some time Sr. GM(Pers.) is on tour. However, he assured that in the next week on the availability of all the Committee Members the meeting date will be decided to sort out the issues.

  4. Regularization of officiating JTOs: GM(Estt.) mentioned that regularization of officiating JTOs can't be initiated due to pending court cases in Hon'ble Chandigarh High Court and Ernakulam High Court. The case is posted for hearing on 31.07.2012 in Hon'ble Chandigarh High Court and judgement is reserved  in Ernakulam high Court.

11.07.2012: DPC from JTO to SDE promotion of Seniority-cum-fitness Quota: The correction in the circulated seniority list is pending from Circles i.e. AP, BR, CHG, CHTD, HP, HR, KTK, MH, MP, NE-I, NE II, NTR, OR, PB, RAJ, TN, UKD, UP(W) and WB.

LDCE Quota, JTO to SDE promotion: The VCRs are not yet received from BR, HR, ITPC, J&K, KTK, MH, OR and UKD Circles.

All the concern Branch Secretaries are requested to ensure early Correction in Circle gradation list to expedite DPC and promotion order.

10.07.2012: BSNL's appeal dismissed against Hon'ble Ernakulam CAT, wherein BSNL was directed to fix the pay of the seniors at par with the juniors:- Hon'ble High Court of Kerala has dismissed the petitions OP CAT 1576 ,1560 & 1592 of 2012 filed by BSNL against the order of Hon'ble CAT Ernakulam in OAs 109, 110, 236 & 241 of 2011(filed by Sethumadhavan & others) which directed BSNL to fix the pay of the seniors at par with the juniors drawing more pay. The Hon'ble Court also observed the unconstitutional part of the condition incorporated in the pay fixation criteria which prohibits complaining against anomalies. Court also commented that such condition is very primitive and against the fundamental rights. As the applicants in the OAs have already filed petition for contempt of court against BSNL, the Hon'ble Kerala High Court allowed three months' time for BSNL to implement the orders passed by CAT.

10.07.2012: GS, President and AGS (C/E/Arch./TF) met  PGM(BW) and discussed:

  1. Request / tenure  transfer cases of SDEs(C) who have completed tenure: We requested PGM(BW) to issue transfer order of SDEs(C) who have completed tenure. PGM(BW) assured that he will look into the matter.

  2. Accommodation of SDEs(C) of NE Circle who have recently been promoted: We requested PGM(BW) to accommodate the SDEs(C) of NE Circle who have recently been promoted  in NE Circle. PGM(BW) assured to examine the cases.

  3. Issue of vacancy of SDEs(C) as per RR issued vide no. 20-1/2001-PersII/dt. 06.03.2012 : We   expressed our serious concern against  wrong calculation of number of vacancies of SDEs(C) as 1073 instead of sanction posts of SDEs(C) -1365. We requested that the matter needs clarification. PGM(BW) assured that he will look into the matter as well as the sanction   and working posts of SDEs(C) of each Circle will be reexamined.

  4. The issue of BSNL MSRR-2009 should be amended and parity at par Telecom & Finance Wing executives should be given to C/E/Arch. executives. The details of rulings & copy of various RR's of CPWD have been given. We also express our submission that the LDCE SDEs whose seniority list as per DoT may be intact and not affected by these amendment of MSRR. PGM(BW) assured to reexamine the case.

  5. Deputation of Civil Wing executives to other Govt. departments/PSUs: We requested to allow BSNL Civil wing executives on deputation to other Govt. departments/PSUs e.g. in Rajasthan Telecom Civil Wing executives are posted in Sales & Marketing work which is not their expertise. PGM(BW) assured to look into the matter.

  6. DPCs from JTO(C) to SDE(C) and SDE(C) to EE(C), EE(C) to SE(C): We requested to expedite DPCs to fill up vacant SDEs(C), EEs(C) and SEs(C)   posts. PGM(BW) mentioned that first regularization of SE(C)  in process and will be completed, then promotion of EE(C) to SE(C) will be initiated. After that SDE(C) to EE(C) & JTO(C) to SDE(C) process will also be started.

06.07.2012: GS discussed with PGM(EW) regarding:

  1. DPC from SDE(E) to EE(E): PGM(EW) informed that DPC process has been initiated, the ACRs/VCRs have been called for the eligible SDEs(E) to fill up about 40 EEs posts. He assured an early action in this regard. We also requested to ensure correct implementation of SC/ST roster on promotion.

  2. DPC from EE (E) to SE (E): We requested to expedite DPC from EE (E) to SE (E) to fill up about 18 SEs vacant posts after getting the one time relaxation in the eligible condition of EEs (E) from the competent authority. PGM (EW) mentioned that DPC process has been initiated and the ACRs / VCRs have been called from Circles to expedite DPC.

06.07.2012: GS, FS met Addl. CVO and Dy. CVO, BSNL CO to discuss:

  1. VCRs to BSNL CO Pers. Cell and SEA Cell: We requested Addl. CVO for early sending of VCRs of eligible DEs to DGM(Adhoc) promotion and eligible AOs to CAO(Adhoc/Regular) promotion. Addl. CVO immediately discussed with the concern AGM(Vig) and directed him for early sending of VCRs.

  2. Early settlement of pending appeal cases: We requested for early settlement of the pending appeal cases. Dy. CVO, discussed the matter with concern AGM(Vig.) and mentioned that about 25 appeal cases are under consideration and will be settled shortly.

06.07.2012: GS, FS met DGM(Pers.), BSNL and discussed regarding the committee meeting to discuss the issues i.e. non-implementation of CPSU cadre hierarchy, introduction of E-2 & E-3 standard IDA pay scales of JTO/ SDE equivalent executives and diversion of 600 DGM posts . DGM(Pers.) mentioned that the meeting of the said Committee is proposed to be held on 10.07.2012.

05.07.2012: GS, President, AGS(HQ) met Sr. GM(Pers.) and discussed:

  1. DPC from DE to DGM: We requested to expedite DPC from DE to DGM(Adhoc) to fill up about  400 vacant DGM posts. Sr. GM(Pers.) mentioned that ACRs/VCRs of eligible DEs has been called from Circles and as soon as the ACRs/VCRs are received DPC work will be completed.

  2. DPCs from SDE(T) to DE(Adhoc & Regular):We expressed our serious concern against non-holding of DPCs from SDE(T) to DE(Adhoc & Regular). Sr. GM(Pers.) mentioned that Hon?ble CAT Jabalpur has posted case for final hearing on 25.07.2012 wherein stay order continues against holding of DPCs. Similarly in the SC/ST Court case of Hon?ble Chandigarh High Court the legal opinion has been sought. He assured that as soon as the court stay order is vacated, DPCs will be completed immediately.

  3. JTO to SDE(T) Seniority cum fitness quota DPC: We requested to expedite DPC from JTO to SDE(T) of seniority cum fitness quota. Sr. GM(Pers.) mentioned that the Circle gradation lists from all the Circles were called for but many Circles are yet to sent the gradation lists to prepare final All India Seniority list of JTOs for SDE promotion. He assured to issue reminder on this issue to Circles. All the Circle/Branch Secretaries are requested to ensure sending of required documents to BSNL Corporate Office at the earliest to expedite DPCs.

  4. Posting of SDEs(T) on promotion through LDCE quota: We requested for posting on promotion to SDE(T) from LDCE quota JTOs in the same Circles or nearby Circles. Sr. GM(Pers.) mentioned that due to recent court case (details awaited) the posting  on promotion are held up. However, as soon as the court stay order is vacated the posting on promotion of SDE(T) will be issued.

  5. Antedating of DNI and removal of Pay anomaly wherein seniors are drawing less salary then their juniors:  Sr. GM(Pers.) immediately spoke to GM(Estt.) to hold an early Committee meeting to discuss the issues. GM(Estt.) informed that GM(EF) is on leave and after her joining the Committee Meeting may be hold to resolve the issues.

  6. Consideration of Tenure/request transfer: We requested to consider all pending tenure/request transfer of SDEs/DEs. Sr.GM(Pers.) assured to look into the matter.

04.07.2012: GS, President, President SNEA(I), GS BSNLEU, President, NFTE(BSNL) met Director (HR) and requested to finalize management Committee Note on 78.2% IDA fitment pay fixation issue for approval in BSNL MC and  BSNL Board. After some discussions Director (HR) assured an early action in this regard so that in the next MC meeting it is put up for approval.

04.07.2012: Hon'ble CAT Chandigarh Bench vide OA No. 647/2012 between Mr. Narender Singh V/s others granted stay on  JAO/AAO to AO DPC. The case will come on hearing on dated 05.07.2012.

03.07.2012: GS, President, FS, AGS(HQ) met Director (Finance) and discussed

  1. Implementation of DPE OM dated 2nd April,2009 regarding 78.2% IDA Pay Fitment Case: We requested for giving an early financial concurrence to the Management Committee (MC) Note for implementation of DPE OM 2nd April,2009 regarding 78.2% IDA fitment benefit instead of 68.8%. Director (Finance)  mentioned that MC Note on this issue is under consideration in EF Cell and shortly clearance will be given to MC Note.

  2. DPC from CAO to DGM: We expressed our serious concern against delay in holding DPC from CAO to DGM(F) posts. Director(Finance) mentioned that MC Note for relaxation of eligibility condition for the promotion of CAO to DGM has already been sent to MC for approval and further assured that in tomorrow MC Meeting the same will be put up for approval.

  3. DPC from AO/Sr. AO to CAO: We expressed our serious concern against the delay in DPC from AO/Sr. AO to CAO . Director(Finance) mentioned that still about 30 ACRs are pending and VCRs from about 15 Circles are awaited, he assured that DPC will be conducted soon.

  4. Regularization of Postal JAOs: We requested for Regularization of Postal JAOs as per DoT clearance. Director (Finance) assured an early action in this regard.

03.07.2012: GS, President, FS,  AGS (HQ) met Director (HR) and discussed regarding

Two weeks of training to executives whose pay is upgraded and on every promotion under EPP- needs review:  We expressed our serious concern that as per EPP every executive whose pay is upgraded to next higher IDA pay scale, the concerned executives shall have to compulsorily undergo Two Weeks of Training for being eligible for drawl of Second increment in the upgraded IDA scale. But later on it was changed to e-mode and online examination w.e.f. 01.04.2011 in view of saving expenditure of TA/DA and training Centres establishment cost etc considering the state of BSNL Finance. Even though saving is achieved in not conducting the classes, but the executives were asked to go to RTTCs to write the exams by incurring expenditure on TA/DA, which again a huge expenditure on BSNL.

Moreover, there is no such training provision exists in BSNL's non-executive promotion policy as well as no such training provision is envisaged in the BSNL MSRRs on Post based promotions to Group-'A' level executives. Also deputationist officers are getting uninterrupted functional promotions against BSNL's posts without undergone of any training course. We requested that the training/examination clauses of EPP are immediately withdrawn to save the huge expenditure of BSNL and to provide justice to Group-'B' level executives in BSNL. Director (HR) mentioned that as per EPP provisions Two weeks training is mandatory for executives on each financial upgradation. He also mentioned that instead of withdrawing it the training can be provided by conducting classes in training centers. However, he assured to discuss the matter with GM(Trg.) to settle the problem, being faced by some executives through e-mode and online examination.
