07.09.2013: Branch Conference of Transmission Branch: Branch Conference of Transmission Branch held on 07-09-2013 at 2nd Floor, Amenity Block, O/o PGMTD, Jaipur. Com. Prahlad Rai, GS attended the meeting as Chief Guest. Com. M.K.Morodia, Circle Secretary & Com.K.K.Barsar, Org.Secy(C) Raj. also attended and addressed the meeting.

Com. Prahlad Rai, described all the issues at CHQ level in details during his address. He appreciated the active role played by Transmission Branch in all the organisational activities in Rajasthan Circle. He said that Transmission Branch is one of the strongest Branch.

Com. GS assured that AIBSNLEA is the largest association and we will definitely achieve first place in membership verification. 26.08.2013: Meeting of CEC members stationed at Jaipur: A meeting of CEC members stationed at Jaipur held in the room of CS at CTO building, GPO campus M.I.Road Jaipur on 26.08.2013 at 13:00 hrs. the meeting was presided over by Com. H.L.Awasthi, most of the CEC members stationed at Jaipur attended the meeting.

Brief of the discussion held:

• CHQ office bearers, Advisors and CS meeting held at Delhi on 3-4 Aug'13:- CS apprised the members about the discussions/decisions held in the meeting of CHQ office bearers, Advisors and CS,  at Delhi on 3-4 Aug'13. Though the performance of Rajasthan Circle was dominating in above meeting but delay in CHQ quota clearance and difference between actual membership and quota paid was specified in the meeting.

• Draft for BSNL's Own Rules and regulations governing Conduct of Membership Verification of Executives' Associations in BSNL:- Every para of the draft was analysed thoroughly. amendments were suggested for the paras which were against the interest of Association setup. the amendments  have been sent to the CHQ incorporating the  objections received from out side other CEC members through Email, for further transact with BSNL management.

• Over view of the Organisation in Rajasthan:- It was decided to make special efforts to increase the membership. It was felt that organisational activities at SSA level must be more fruitful and energetic.

• Collection of Advertisement for AIC Nasik:- It was decided that every branch will collect advertisements for AIC Nasik as maximum as possible but not less than Rs. 2,000/-.

23.08.2013: GS, AGS(HQ), Com. Shiv Kumar, President AIBSNLEA Tamilnadu Circle met Sr.GM(Pers.) and discussed following issues

• Modifications of some DEs / SDEs posting orders on medical grounds: Sr. GM(Pers.) mentioned that some medical ground cases of DEs on promotions are being examined and shortly decision will be taken as joining time will expire shortly. The cases of JTO to SDE(LDCE Quota) on genuine reasons now may be considered by Director (HR) only since the 40 days joining time is over. However, he assured an early decision on pending cases.

• DE to DGM Promotion: We requested to fill up about 400 vacant DGM posts by giving one year relaxation in the eligibility condition of 4 years service to DEs  as per BSNL MSRRs. Sr. GM(Pers.) assured that shortly the proposal will be sent to the Competent Authority to initiate CPC from DE to DGM.

• CPC from SDE to DE Adhoc/Regular: We requested to fill up all the vacant DEs posts on adhoc/regular basis. Sr. GM(Pers.) mentioned that CPC from SDE to DE regular is in progress against vacancies of 2010-11 and 2011-12 but some ACRs and VCRs are still awaited and now it is learnt that Hon'ble High Court Chennai has given direction not to operate TES Group-'B' seniority lists finalized in the year 2007 on year of recruitment basis for SC category executives and operate year 2002 TES Group-'B' seniority list on the basis of Rule-206. Hence, immediate CPC DE Adhoc/Regular may not take place till the clear directions is taken from the Hon'ble Court.

  Regarding utilization of vacant MT quota DEs posts for DE adhoc promotion, he mentioned that CMD is not in favor of adhoc/local officiating promotions. Hence, the local officiating promotions in executive cadres have been replaced by looking after arrangements and now it is proposed to keep 1000 DEs posts for MT Quota and remaining about 4200 may be kept for seniority-cum-fitness quota. Already for  150 MTs recruitment, BSNL C.O. DE Cell has been asked to notify examination from internal candidates immediately and after the amendment is made in BSNL MSRRs, the 4200 DEs posts will be filled on regular promotion basis, thus, the adhoc promotion in DE cadre will end.

  It is known fact that 50% of DEs posts of MT quota were being filled up on adhoc basis as per BSNL MSRRs and 50% DEs posts on regular basis from seniority cum fitness basis from SDEs(T). This provision in BSNL MSRRs came into existence on the basis of Joint Committee Headed by Sh. S.R. Kapoor, the then PGM(FP) with the representatives of Executives Associations and BSNL Officers. However, CMD desires that there should not be adhoc promotions and there should be only Regular promotions by fixing 1000 MTs posts which is being demanded by this Association since formation of BSNL is a welcome move. In this manner after the BSNL MSRRs amendments, there will be only regular promotions in DE cadre. Sr.GM (Pers.) mentioned that shortly the proposal of BSNL MSRRs amendment will be sent to the Competent Authority for approval.

• CPC from JTO to SDE and LDCE: Sr.GM(Pers.) mentioned that CPC from JTO(T) to SDE(T) is in progress but some Circles are yet to send the VCRs. Similarly GM(Rectt.), BSNL C.O. has been informed  to notify LDCE against 1883 vacancies under 33% LDCE quota i.r.o. SDE(T) for the vacancy year 2010-11(1287), 2011-12(273) and 2012-13(323). Shortly the LDCE will be notified.

23.08.2013: 147 SDEs(LDCE Quota) Court case status: The case was listed for hearing on 23.08.2013 as Item No. 49 in Court 9 before Justice Nijjar and Justice Kalifulla at the Hon'ble Supreme Court of India.

Mr. P.S. Patwalia, Senior Advocate appeared on behalf of Respondent/Caveator No. 8. Mr. P.P. Rao, Senior Advocate appeared on behalf of the Petitioners. The Hon'ble Court was pleased to issue notice in the matter without any interim directions. As such, no stay has been granted by the Hon'ble Supreme Court on the Judgment dated 01.07.2013 passed by the High Court of Kerala. Notice was accepted for Respondent No. 8.

17.08.2013: AIBSNLEA notified its 4th All India Conference: AIC will be held from 10th November, 2013 to 12th November, 2013 in Sapkal Knowledge Hub, Kalyani Hills, Anjeneri, Trambak Road, Nasik, Maharashtra.

• All the Branch Secretaries may take necessary actions for early election of the Delegates for participation in the AIC as per the provision laid down vide para 3.A.I(a) of the constitution of AIBSNLEA (i.e. one Delegates per 30 paid members or part there of being not less than 20 subject to the minimum of two per Branch shall be elected by the branches).

• Delegation fee has been kept Rs. 1200/- per delegate. Delegation fee, Fare & other expenditure during journey will be borne by the branch.

08.08.2013:Alwar Conflict is resolved; BS Alwar has deferred the proposed Agitational programme w.e.f. 12.08.2013: Alwar Branch had served a notice for Agitational programme to SSA Management against biased & ignorant attitude of GMTD Alwar on 28.07.2013. the issue was taken up at CGMT level and SSA level. finally CS & OS(North), CHQ, OS(East), Branch Secy. & Br. President had a meeting with GMTD Alwar on 05.08.2013. After a long discussion in the meeting a consensus was developed between management and Association.

Now since SSA management has acted in positive direction, Alwar Branch has deferred the Agitational programme w.e.f. 12.08.2013 and things have been settled in peaceful manner.

28.07.2013: Wasted interest of Vindictive & dictator Management has compelled the Comrades of Alwar SSA to move on the path of agitation.: Comrades of Alwar SSA are being harassed & victimized by vindictive & biased GMTD Alwar. GMTD Alwar is totally ignorant towards the legitimate rights of the Comrades of Alwar and the interests of BSNL, Now the situation has become very explosive in protest of malafide intension of GMTD Alwar. CGMT Rajasthan has been well apprised with the issue in details by CS, AIBSNLEA but nothing has been done at Circle management level and the matter has totally been ignored. 26.07.2013: 270 SDEs Court Case Status: Civil appeal No 3149 of 2009 is pending in the Hon'ble Supreme Court against the judgment and order dated 02.04.2008 passed by Hon'ble High Court of Madras in a W.P.(C) No. 21961 of 2001 by which the Hon'ble High Court has dismissed the writ  petition filed by BSNL and confirmed  the order of CAT Madras quashing the seniority list  assigned to 270 SDEs vide order dated 01.02.2001 and directed for re-drawing this seniority.

The Hon'ble Supreme Court on 12.05.2008 passed interim order for maintenance of "Status quo" inspite of the said interim order BSNL issued promotion order for the posts of DGM to 172 DE/AGM out of 270 SDEs on 08.02.2013. Contempt petition no. 403 of 2012 was filed by promote Sh.M.Shamugam for initiating contempt processing against contemnor CMD BSNL and other officials of BSNL. The said contempt petition no. 403 of 2012 was listed before the Hon'ble Supreme Court on 26.07.2013 (today) and the Hon'ble Court issued show cause notices and directed for personal appearance of contemnors CMD, BSNL, Director(HR) and AGM (Pers.) of BSNL. Order will be available within 3 days and shall be submitted.

26.07.2013: 147 SDEs (LDCE Quota) retrospective seniority case in Hon'ble Supreme Court: CC 13059/2013 of  Ruperndra Pathak & Ors Vs. Union of India & Ors was listed for hearing on 26.07.2013 in Hon'ble Supreme Court in Court 9 (Item no. 19), It is adjourned to 31.07.21903 for hearing as the bench will not sit due to non-availability of  Hon'ble Judge and the matters shown before the court in the daily list for 26.07.2013 issued on 22.07.2013 will now be taken up by the bench presided over by Hon'ble judge on 31st July,2013.

Meeting of the Forum with the CMD on 22nd July 2013

The Forum leaders met Shri R.K. Upadhyay, CMD, BSNL on 22nd July 2013 and discussed the following issues regarding the expansion, customer services etc:

• Maintenance of BTS: The Forum leaders pointed out that a good number of BTS are not either functioning or are having difficulties of power connection / shortage of diesel etc. There is much delay in repairing fault. This is adversely affecting the services. CMD assured that action is being taken in this matter.

• Disposal of scraps: The Forum pointed that despite corporate office instructions, the scrap materials have not been disposed. BSNL will be getting Crores of rupees in each SSA if the scraps are sold, which will also keep the stores and premises clean. CMD agreed to issue suitable instructions in the matter.

• Renting, Leasing of vacant quarters / office buildings /training institutes etc: The Unions wanted that the vacant quarters / offices be rented to Central Govt./State government/PSUs so that some revenue can be earned. In the same way, the training institutes can also be rented for training purposes government establishments etc. This is being done to a certain extent at present which can be extended to other places.

• Telecom Factories: The Forum demanded that the Telecom Factories be modernized, new engineers recruited and new items introduced for manufacturing. Thousands of towers are manufactured and available in Telecom factories, but in some SSAs, the same are purchased from outside. It should be ensured that the towers should be purchased from TFs only.

• It was also suggested that the production of drop-wire should be increased, since there is shortage at present. New products should be manufactured.

• Marketing to be expanded: The Forum stated that putting more executives and non-executives in the Marketing section will be necessary.

• Procurement of equipment: The unions pointed that despite supply of some cable, there is still acute shortage. CMD informed that tender for more cables are in the process and will be finalized quickly. BSNL is making all efforts for the utilisation of the Europe- India Gateway under-sea cables by negotiating with the other companies on the issue of making available the platform at Mumbai.

• Regular meetings of Works Committee: Though instructions have been issued one year back to form Works Committees in all the SSAs with the participations of the representatives of the unions, it has not been implemented. The works committees should start functioning immediately, where discussion can take place and decision taken on the expansion and improvement of services. CMD was positive on this issue.

Both the CMD and the Forum agreed that similar meetings will be much helpful in improving the financial viability and service of BSNL.

19.07.2013: Posting order of CAOs on Promotion  to DGM(Fin.) Adhoc  will be issued on Monday: It is reliably learnt that posting order of CAOs on promotion to DGM(Fin.) Adhoc is expected to be released on Monday after the approval of CMD, BSNL to fill up  24 DGM(Fin.) posts.

19.07.2013: Promotion orders of 1587 DEs are issued:

Congratulations! AIBSNLEA consistent and untiring efforts yielded result in getting released the posting on promotion order from SDE(T) to 1587 DEs on  Adhoc basis   (OC= 1240, SC= 249, ST= 98 ). The CPC is conducted to fill up 1860 DEs Posts (OC= 1445, SC= 293, ST= 122). But  273  DEs posts  could not be filled up  as in OC category 156 (137 shield cover cases + 19 from 147), SC category  44 (42 un accessed + 2 of 147), ST category  24 (24 un accessed + 0 of 147) and misc. reasons.

The last promotion orders from SDE (T) to DE Adhoc were issued in June & July, 2010 of 2700 DEs, thereafter, we continuously tried to get filled up the vacant DEs posts. BSNL Management initially agreed to fill up 760 DEs posts of seniority - cum - fitness  quota and initiated the CPC process but meanwhile we continued our efforts to fill up MT Quota posts from  SDEs(T) to DE on adhoc basis as per BSNL MSRRs provisions. Finally, CMD BSNL and BSNL Management Committee allowed to utilize 1100 MT quota posts. After this, BSNL C.O. Pers. Cell started CPC process to fill up 1860 DEs posts. We tried our level best through our Circle Secretaries to get collected the ACRs/VCRs of eligible SDEs and finally got completed. During the period so many court cases took places and stay order was granted in the Hon'ble CAT Chennai wherein we got impleaded and finally  stay was vacated. Further attempts are made to stall CPC by some individuals but could not succeed and finally today, the promotion order is issued. About 273 SDEs are yet to be promoted against remaining vacant posts of 1860 DEs shortly . 17.07.2013: GS met GM (FP) BSNL CO and discussed:

• CPC from CAO to DGM (F): We requested for early issuance of promotion order from CAO to DGM (F) to fill up 25 DGM (F) posts. GM(FP) mentioned that CPC from CAO TO DGM(F)  has been completed  and efforts are being made to issue promotion order by Friday on 19.07.2013.

• CPC from CAO (Adhoc) to CAO (Regular): We requested to expedite  CPC from CAO (Adhoc) to CAO  (Regular)  for filling up 272 posts regular basis. GM(FP) mentioned that CPC is in process but VCRs are yet to be received from CVO. However, he assured that as soon as VCRs received promotion order will be issued.

• CPC from JAO to AO: We expressed our serious concern against non holding of CPC to fill up about 1500  AOs posts. GM(FP) mentioned that  he could not concentrate to take further legal opinion of BSNLs senior advocate in BSNL CO on the pending court cases in Hon'ble CAT Chandigarh. He assured that as soon as the CPCs from CAO to DGM (F) and CAO (Adhoc) to CAO (Regular) are completed, this Issue will  get priority. cadre

• Allowing Local Officiating arrangement in JAO Cadre: We requested for early issuance of  necessary order for allowing Local Officiating arrangement in JAO cadre from Non - Executive cadres as allowed in the JTO cadre  and as assured by Director (F) . GM(FP) informed that after the approval of Director (F), the order for allowing Local Officiating arrangement in JAO cadre has been issued and he immediately provided us the order copy, which was immediately up loaded on web site.

• Consideration of request/Tenure Transfer cases of AOs/CAOs: GM(FP) mentioned that CMD has directed to implement all the transfer orders of AOs /CAOs issued for NE Circles and he assured to examine the pending cases.

17.07.2013: GS met GM(Estt.) and discussed:

• Regularization of Offg. JTOs as one time measure: We requested to take necessary steps to regularize Offg. JTOs as assured since the pending court case in Hon'ble High Court Chandigarh is dismissed. GM(Estt.) mentioned that let, the court judgment copy be received and the results of LICEs are also declared, necessary steps will be taken in this regard.

• Pay fixation of Offg. JTOs under FR 22(1)(a)(i): We requested to implement Hon'ble Supreme Court judgment for all the Offg. JTOs for pay fixation under FR-22(1)(a)(i) rule w.e.f. the year-2005. GM(Estt.) mentioned that he has to re-examine the case and thereafter only he will be in a position to mention something on this issue.

17.07.2013: GS met Sr. GM(Pers.) and requested for early issuance of promotion order from SDE to DE to fill up 1860 DEs posts on adhoc basis and about 1500 DEs posts on regular basis. Sr. GM(Pers.) mentioned that CPC work from SDE to DE adhoc is over and minutes are being prepared. However, he assured that sincere efforts are being made to issue promotion order in this week itself, if everything goes well.

• Regarding fill up of 1500 DEs posts on regular basis: he mentioned that as soon as the adhoc DE CPC is completed & promotion orders are issued, immediately CPC from DE adhoc to DE regular will be resume and it will be expected in this month itself.

• Posting on promotion as DEs: We requested to accommodate DEs on their promotion to the some Circles where the vacancies are available in view of the age factor of SDEs being promoted and to save BSNL's money. Sr. GM(Pers.) mentioned that posting on promotion order will be issued on the basis of the vacancy position and shortage in the Circles so that all the Circles shortages are equalized.

17.07.2013: Regarding regularisation of officiating JTOs: It is reported that, the Hon'ble High Court of Punjab & Haryana at Chandigarh  was pleased  enough to close the Contempt of Court case COCP 1431/2008 against CMD BSNL & others filed by some petitioners in WPC 5608/2007 in the matter of diversion of DR quota JTO vacancies. The counsel for contempt petitioners has  chosen to withdraw the contempt petition and the high court has been pleased to dispose of the contempt petition on his statement. No adverse observation  with  account to supernumerary posting of Officiating  JTOs have been made by the court virtually accepting the stand of BSNL to adjust earlier test qualifying offg. JTOs. This order will pave way for adjustment/regular promotion of  all other offg. JTOs as a one time measure all over india.

The BSNL Management have to proceed further in an impartial and judicious manner to settle the issues of officiating JTOs  amicably. The present development shows  that the suggestion  already put forward by AIBSNLEA in the matter of regularisation of the remaining officiating JTOs by a one time personal upgradation, is the correct  feasible and viable solution. Now the authorities are also at liberty to settle the issue by creating sufficient number of supernumerary posts. There was no need to wait for the closure of the Contempt of Court Case. BSNL ought to have  initiated  the regularisation of the remaining officiating JTOs through the upgradation as demanded by all recognised trade unions and associations in BSNL.   Now it is  time for the BSNL authorities to act judiciously and keep word as assured in writing  to AIBSNLEA  in this matter  in connection with the  settlement of  the latest Organisational  Actions called by AIBSNLEA.

03.07.2013: Congratulations! AIBSNLEA succeeded in getting released promotion orders of 2380 SDEs of LDCE quota. Majority of SDEs have been given posting in the same Circles on the basis of their rank and junior rank SDEs have been posted to deficit / Hard tenure Circles. The  seniority cum fitness quota SDEs CPC is also in process and on receipt of VCRs, it will be expedited. AIBSNLEA is continuously pursuing for early promotion order.

02.07.2013: 119 DE to DGM promotion order issued: Congratulations! AIBSNLEA consistent efforts yielded result in getting released the promotion order from DE to DGM(Engg.). Total 119 DGM promotion order have been released. Most of the DGMs are given posting on promotion in the same Circles.

Initial approval was to fill up 414 DGMs posts and the CPC was conducted & approved for 230 DGM posts as fit cases but due to case was subjudice,  promotion orders were delayed and as such now the promotion order of 119 DGMs issued. AIBSNLEA efforts will continue to initiate next CPC to fill up remaining about 300 DGM posts. <<<Click Here for Order>>>

02.07.2013: Congratulations! BSNL Corporate Office declared result of LDCE for Promotion to the grade of SDE(T) under 33 percent quota held on 04-03-2012 based on Hon'ble PBCAT New Delhi. Total = 2629 JTOs have been promoted i.e. 2442  General + 148 SC + 39 ST.  The posting on promotion order is expected shortly. AIBSNLEA has requested to post all the newly promoted SDEs in their parent Circles as far as possible and to consider request transfers.

01.07.2013: GS, AGS(HQ) and CS JKHD met GM(FP) and discussed

• CPC from CAO to DGM(Fin.): We requested to expedite CPC from CAO to DGM(Fin.). GM(FP) mentioned that CPC is in process but the VCRs are awaited and he has already spoke to Dy. CVO for sending the VCRs. GS also discussed concern officers for sending the VCRs to fill up about 25 DGM(Fin.) posts.

• Local officiating arrangement in JAO Cadre: We requested to continue with local offg. arrangements in JAO cadre from JAO Part-I qualified non-executives. GM(FP) mentioned that he has sent the case for clearance to GM(Estt.) BSNL C.O. & after getting the clearance  the n/a will be taken.

• CPC from JAO to AO: We requested to fill up about 1500 vacant AOs posts by holding CPC. GM(FP) mentioned that BSNL's advocate of Harayana Telecom Circle has given legal opinion not to issue promotion order. However, legal opinion from BSNL's C.O. advocate at the earliest.

01.07.2013: GS, GS, President SNEA(I) met Sr. GM(Pers.) and discussed:-

• CPC from DE to DGM: We requested Sr. GM(Pers.) for early issuance of promotion order from DE to DGM since the Hon'ble High Court Kerala has pronounced the judgment on 147 SDEs(LDCE Quota) seniority case. Sr. GM(Pers.) mentioned that CPC is ready but the VCRs are awaited and in case, VCRs are received tomorrow F/N, they can issue promotion order in the evening itself to fill up about 140 DGM posts.

  GS contacted concern officers in CVO, BSNL C.O. and requested for an early action in sending VCRs. It is assured that by tomorrow they will submit the VCRs to Pers. Cell. We may expect promotion order shortly. AIBSNLEA has filed cavit in the Hon'ble Supreme Court on 147 SDEs seniority case.

• Posting on promotion from JTO(T) to SDE(T) of LDCE quota: We requested for early posting on promotion order from JTO(T) to SDE(T) of LDCE quota. Sr. GM(Pers.) mentioned that BSNL Corporate Office, Rectt. Cell has prepared the final result of LDCE as per the direction given by Hon'ble PB CAT New Delhi. Efforts are being made to issue posting on promotion order by tomorrow itself in case the VCRs are received. It is expected that promotion order of about 2600 SDEs may be issued shortly.

01.07.2013: Draft report of the Committee regarding introduction of CPSU Cadre hierarchy Vis-a-vis present set up in BSNL. Comments/feedback  are required on the report by 10th July,2013. <<<Click here for the Draft report>>>>

All the Circle Office Bearer/Branch Secretaries are requested to give their feedback/comments before 07th July,2013 so that the same will be provided by 10th July,2013 to BSNL Management.

01.07.2013: 147 SDEs (LDCE Quota) retrospective seniority case dismissed: Hon'ble High Court Kerala dismissed 147 SDEs (LDCE Quota) retrospective seniority case. The judgment is pronounced today after a gap of 4-5 months. It has paved the way for promotions from DE to DGM and DE regular.

All the Branch Secretaries are requested to ensure for early sending of VCRs to CVO, BSNL C.O. at the earliest to expedite CPCs.

01.07.2013: Status of Court Case in 147 SDEs LDCE Quota Seniority case: The said case is listed for pronouncement of judgment on 01.07.2013 at 10.15 AM in Hon'ble High Court of Kerala at Ernakulam.
